  • Need Basic Info - Pls Help A Newbie

    We paid $14K plus closing costs etc. = $15193 Total sales price.
    MF = about $650 Yr,
    we got 15,000 points EVERY OTHER YEAR.
    They gave us bonus nights package, RCI EXTRA VACATIONS PACKAGE (2 WEEKS PER YR FOR 3 YRS), Travler Plus, a free cruise, etc etc.

    now it's the morning after, WOW, i had a feeling it was gonna be like this

    i have no clue what I bought, where do i start? did i get a good deal? I don't think so

    If I don't get some good info by Monday 12-17-07 AM, I WILL CANCEL.

    I will follow the letter of the contract to
    CANCEL PER FLORIDA SATUTE 721.7(6) 10 days
    Purchasor has the right to cancel this transaction without any penalty or obligation. Right to cancel expires 10 calendar days after the date you signed your purchase contract

    Rescind their are much much better deals out there and I don't care what resort you bought at. If it's in Florida you can do much much better than buying from the developer.

    And Yes follow everything in your contract. Return everything they gave you and make sure you send them certified, requiring a signature, return/receipt.

      Thanks lawren2. I think that's what I wanted to hear.
      I will be back to the Forum, - we DO want some good vacation deals. NOT lookin for freebies, just best value for the hard earned dollars

          Rescind!!!

          Listen to Lawrens advice!!!! Never buy retail!!!! Your $15000 purchase is probably now worth
          about $2500 on resale market.
          Here are a few RCI points resales ads, and these are ASKING prices.
          You can buy for a lot less.

          Buy RCI Points - Multi-Destination Timeshare and Search RCI Points - Multi-Destination Timeshare Resales

          Make sure you follow instructions in contract WORD FOR WORD.

          Then come back and read TS4MS for several months. Theres a lot of
          experience and knowledge here that will help you find a timeshare that best fits your needs at a much lower price.

              Dont feel stupid!!!! Many of us, like myself, bought retail BEFORE finding TS4MS. The good news that you are smart enough to know that your purchase was a mistake early enough to do something about it.

                I agree with Lawrens advice. Also like Paul don't feel stupid. The TS industry spends billions per year marketing their properties. They hire slick sales people much akin to used car salesmen. They need to recoup their costs. However walk away from this deal. Between both of my TS's I have spent no more than 3K. I have already been to Orlando, Aruba, and I have confirmations next year to go to the Poconos, and Paradise Island. Stick with this group and you can't go wrong.

                  Please note that all materials which you presented to us at the time of this original contract have been mailed to the above via U.S. Postal Service.

                  We expect you to promptly repay any monies which we have paid to you, specifically $XXXX.00 deposit as shown on subject contract.

                  Sincerely,
                  Signed by myself and my wife

                  (Enclosing a copy of the contract)

                  In a separate package, I will return EVERYTHING I got from them including the "bait" they gave us for coming to the sales pitch. I will of course keep originals of everything we signed.

                    Be sure you send it with the post office (not Fed Ex) and require a signature upon receipt--sent it either certified or registered, whichever they say. Keep a copy of your letter and the post office receipt showing the package was sent.

                      Another thought--if the stuff they gave you comes in a separate package..... I'd send everything together in the same package and expedite the handling AND require a signature showing it was received. Fewer loose ends that way.

                        Be CERTAIN to send your cancellation letter ONLY to the address which is clearly specified for that rescission purpose within the contract document. It matters not a bit where your presentation was actually physically conducted. And, as already recommended, use U.S. Postal Service certified mail, return receipt requested. The "certified mail" part is far more important than the "return receipt" part, since the date/time stamp from the USPS constitutes your documentary proof that you met the contract rescission deadline as provided by state law.

                        As far as your expressed "promptly" expectations regarding timeliness of refund, that may take some time -- and quite possibly 30 days or more. If your deposit was by credit card, it's also be a good idea to be ready to file a written "disputed charge" process with your card issuer, in the event that you have a credit card bill to pay before the refund of your deposit is processed.

                          thanks again to all. the letter was sent today to the address indicated in the contract.
                          i'm confident i have followed florida law to the letter
                          package of "materials' was sent today to same address but i used UPS confirmed delivery, will see signature of receipt online tomorrow sometime.
                          i've already notified CC company of intent to dispsute payment to the company.
                          hopefully they wont act assinine about it, just accept the situation,
                          will end this thread with one last "thanks to all". Will start new thread to announce outcome when it's finalized

                            You did better than I did..my first purchase was through the developer. It was awhile before I found this site, now I have 6 for less than I paid for one!

                              IT'S OVER. received full refund of my downpayment on Dec 29.
                              ONLY 11 days from the date they received my letter to rescind,
                              WOW! IT FEELS SO GOOD.
                              Once again, thanks to all that replied.

                              WE DO WANT TO BUY SOME VACATION TIME so we will be back to get educated in order to AVOID doing something in "IGNORANCE" again.
