  • RCI Class action - Dead or Grinding to a halt?

    It has been a full year since there has been even a one line update to the RCI Class Action site. The lack of news sure sounds like this dog won't hunt. If there was any positive movement they would be trumpeting it for all to see. Instead even the shysters are in hiding - no news is not good news for anyone that actually thinks this thing had merit.

    Most likely they are desperately trying to get a check for what they feel covers their costs and then the whole thing will be dismissed. Proper outcome and, if it occurs, the cheapest end both RCI and the members could hope for.

    It's unlikely there will be chest thumping posts from the shysters when this finally dies so lets hope we get word from RCI or a reliable source that it has been put out of it's misery. Soon.

    With all due respect, and your Perry Mason avatar notwithstanding, I believe that some of the conclusions cited above are simply not correct (despite the absence of web site updates). The case progress has little (nothing at all, actually) to do with posted updates on the Internet.

    In Murillo vs. RCI, briefs on the class certification issue were submitted by both sides a few months ago, with a decision on that aspect of the case now actually already a bit overdue and perhaps to be issued in the remaining weeks before this calendar year ends. Until the judge makes a determination on that specific matter, there is nothing further which can be done by either side --- except to prepare for a course of action based upon that pending decision. The outcome of that aspect of the case will determine whether the case moves forward at all. If class certification is granted, some speculate that RCI may well scurry for an out of court settlement (possibly being constructed for submission right now, but that's certainly pure speculation on my part). If class certification is denied (highly unlikely, in my personal opinion), then the case will indeed be "dead on arrival". In either development, however, the absence of web site updates is not indicative in any way of actual case progress --- there is quite simply nothing to report until the judge renders a decision on the issue of class certification.

    This case is not going to just "die on the vine", in my opinion. I believe that the plaintiffs in this matter are committed, with their heels firmly dug in, intent upon acquiring a court decision. The millstone wheels of justice may turn slowly --- but they eventually do grind quite fine...

        In the final sentence of my post, I probably should have used the words "court system" instead of the word "justice" --- since the two concepts are often entirely unrelated and often don't even get to meet one another.

          The apologists for RCI's malpractices should not be celebrating too early.

          This case is young as complex litigation goes. The discovery process is extensive and timeconsuming. Finding some information, usually leads to new questions and more discovery.

          And, hey, this is still at the class certification level. It is not yet even in the discovery on the substance of the case yet.

            Using the rational that the web site hasn't been updated would be the equivilent of saying DRI didn't buy out Sunterra last April. After all, the DRI website for Polo Towers, it's flagship resort, still hasn't been updated.

            This stuff takes a really long time. Until we learn of a decision on the class certification I wouldn't be holding my breath........either way. Speculation at this point is pure foley from either side.

              Lawyers are involved so if this reaches a conclusion before they have run up as many billable hours as they can reach before reaching their firms limit whatever it may be and/or we all die from global warming/freezing, I would be surprised.

                The point is if this takes 4-5 years (not an unreasonable time for this type of fishing tour) whatever value there may have been to stopping the practices will be moot. In that time RCI weeks are likely to be a minor sideline for exchanges as RCI Points continues to grow. If in fact things alleged are true members can easily drop their membership and use other options - exactly what would happen if this was successful. But by simply letting the market take it's natural course there is no windfall for the shysters thus their desire to take action even when no actionable problems are there to "correct".

                The absolute silence from the plaintiffs speaks volumes. This is not going well (we already know the guts were ripped out of the complaint - it is down to a few very minor items) and they are no longer looking for memebers to join the so far non-certified class action. Thats because it's not likely to succeed and if it does it will be for pennies. Why waste the money, time and effort?

                Over 18 months ago it was predicted this was a dead end. The more time goes by without a peep from the originators the more likely it will quietly fade away. Let sanity prevail.

                  jIn case you haven't figured it out, good lawyers play to the courts, not the peanut gallery. Several heavy duty law firms are involved for the plaintiffs, but I suspect whoever is responsible for web updates is probably a paralegal at best.

                  It is not ''the market'' that is a threat to RCI Weeks, it is RCI's unfair thumb on the scales, looting Weeks to build up the parasitical Points system. I would welcome a REAL market test by decoupling the two systems and then see if Points could survive without mooching off of Weeks.

                  Yes, you did make the same prediction 18 months ago, and it is no more true now than it was then.

                  While I would call it the ''guts'' and it certainly wasn't ''ripped out'', I would have to agree that not including the points/weeks interface in the combined amended complaint just means that issue will have to be litigated seperately in another action. Originally two RCI class actions were filed, and one included that issue and one did not. When the two actions were consolidated, the various plaintiffs lawyers had to sit down and agree on an amended complaint, and that issue was unfortunately left out at that juncture.
