I have been reading this awesome board for the best part of a week now and decided to jump in and ask a few questions.Everyone seems so welcoming and doesn't make anyone feel stupid for asking questions..I'm almost embarrassed to ask these things, but I have absolutely NO clue how else to find the answers. First of all I will explain my situation..I am trying to help out my daughter,who in a young foolish love, bought a timeshare with her then boyfriend..(huge mistake as we all new he was a loser living off of her) finally she saw the light and left him. Now 4 years later we are trying to decide what to do with this TS..she still owes on it and know she will never see what she paid for it in the end. Also know that she's basically stuck with it as she won't let her credit score be affected. She recently contacted him and he said he would sign a QCD..I have checked with several attorneys along with Title Co's and they have told me they don't deal with TS's..SO, I searched the web for answers..many times I have seen where I can just download a QCD for the appropriate state and county (FL) fill in the names of the Grantor & Grantee,address's etc.. and the legal description..here lies the problem..What I see as the legal description is not what like I see on my home deed..Parcel Lot Plat Book Page etc..what I can take away from the information of the Short Form Mortgage page is:
"Timeshare Period/Unit Week **(E) in the Condominium Unit No.***-*** of *******according to the Declaration of the Condominium thereof,recorded in the Official Records Book **** Page**** Public Records of *** Florida and all of the amendments thereto,if any."
I have substituted asteriks for the real information..Is this familiar with any of your TS legal desriptions? I'm SO lost here..plus he's on the RCI program paper that was signed..how the heck do I get him off of this program also as this seems to be separate from the TS sale itself..then I have to figure out what the heck she's paying for in what is called RSI Vacation Club that she's billed for annually that is attached to the Condominium.. I don't want to miss something and have to contact him again to sign something else (he's so in debt we may never find him again)..We just want this dealt with and never see this guy again.
She pays the mortgage monthly..then annually she pays her M/F along with and RCI payment & also this RSI thing..it adds up to alot for her so we are helping her out..she's a good girl who made a huge foolish mistake and is well aware of it.I'm just trying to get this together for her so that at least once it's paid off it's hers alone..and not connected to him in anyway with these other programs..
Once this QCD is taken care of I'm hoping to just drive over to the county court there and have it filed..then I guess I'll figure out how to get the final papers changed to her name only..guess it's one step at a time here..LOL
I have read so much on these TS papers it makes my mind spin with even/odd years, Flex Plan, RCI points it's way to much for anyone to deal with..I feel any TS company selling TS to kids is totally worthless.Shame on them.
Thank you in advance for any advice or help anyone can give me on this matter..never dealing with a TS has me at a total loss even with the TS language and acronyms.
