  • Kings Creek Resort Rental Program PROBLEM - NRLJR, Inc. Nelson Lewis

    I received this email today. I never new this system existed - but people who used it should know about this.

    Dear Owner,

    Over the years, many of our owners have opted to place their King's Creek week for rent, utilizing the resort's rental program under the management of Nelson Lewis. In 2008 Mr. Lewis developed his own exchange-rental program under the name of NALJR, INC and solicited owners to rent through his company. In August of 2010, Mr. Lewis passed away and the resort has received a great number of inquiries regarding various aspects of their rental agreements with NALJR, INC.

    As a result of our discussion with one such owner inquiring into the status of NALJR, that owner referenced an email they had received directly from Kathleen Childress, Executor of the Estate for Nelson A. Lewis, Jr. What follows is an excerpt from that email communication:

    > I'm sorry to advise you . . . the decision has been made to turn the business over to the state of VA for chapter 7 bankruptcy. There is not enough money in the account to pay monies due to owners. The bankruptcy attorney/trustee will review and notify individuals effected by the bankruptcy.

    > 757-369-8657

    We believe it is important that this information be provided to all King's Creek Plantation timeshare owners and more specifically to those who either had 2010 property listed with NALJR at the time of Mr. Lewis' death and may have rental monies due you or currently have 2011 property listed with NALJR for future rental.

    If you have questions specific to how this may impact your ability to collect outstanding rental monies or if your upcoming week is in jeopardy, please refer those inquiries to Ms. Kathleen Childress at 1-757-369-8657 or email her at traveltova@aol.com.

    did you use this program?

    I rented my 2010 week, but I'm really not sure whether it went through Kings Creek or through Mr. Lewis' company. I'm going to call KCP when they open and find out. Who else rented their week out last year?

      I also received this email. I was under the impression that Nelson was an employee of Kings Creek, therefore Kings Creek should be responsible. Is there a way all Kings Creek owners who rented their timeshares in 2010 and 2011 get together with a lawsuit? Thank you for all responses.

        Show me the money....

        I also rented a unit via Nelson Lewis which rented sucessfully in August and the full rental amount was obtained by Nelson.

        We were told we would receive our rental money in October.

        I have on several occasions been in email contact with Katie Childress. Lately over the last four weeks she has not responded to any of our emails nor have I received any information regarding the status of our receiving our rental money other than what was posted by the Kings Creek Attorney.

        Katie has for some reason stopped responding to my emails but she had previously informed me that all owners who had a contract with Nelson would be paid first in the order they were rented. Obviously this has changed according to this posting and I fear something is being done that may be improper to avoid making payments.

        I had also been told early on that Katie wanted to continue Nelsons Legacy in the timeownership business so my question is where is our money and how do we pursue trying to obtain it.

          Sounds like the business was the man and now it has no real assets. If the executors plan to or have filed bankruptcy for the estate then thee is little to no chance anyone will get money due returned. That is an unfortunate risk in any transaction and in this case those with outstanding money due look to be out of luck.

          A lawsuit could be filed and maybe even won but if there are no assets then it would be a costly & hollow "victory" as there would be costs to the lawsuit that would also never be recovered.

          Probably best to consider this a lost cause. It is also obvious that the resort is making it clear they are not a party to the deal.

            More Information on Nelson Lewis Problems

            I realize that Kings Creek is denying any involvement however I received an email from Katie Childress on October 27, 2010 which may indicate otherwise.

            I received this additional information from her while in communication to confirm that our week had been rented and to confirm that the money we were due was received.

            Within that email was a statement which directly implicates the involvement of Kings Creek Plantation (KCP). She wrote and I quote her response about the owners being paid, "A big part of the accounts receivable/payable is monies Nelson is due from KCP which I am hoping they respectfully submit."

            It makes me wonder, having dealt with Kings Creek who has rather unorthodox methods of how they make payments to owners who rent through them, if the shortage of money in the estate due to the owners is due to their failure to pay money that is due to the estate.

            What I do know with certainty from having spoken to Nelson prior to his passing is that our rental fees were collected, so someone received the money for our rental week, and I am relatively sure that Nelson told me that rental payments were collectecd by KCP when the renting parties departed.

            Kings creek will never confirm having collected the money only that the week was rented.

            Something is definately not right with the process and it may take an investigation to determine the dealings of the involved parties and to track where or why the money is being witheld.

            Nelson Lewis was an honorable man of Integrity and was highly respected having many years in the business and a man who valued his reputation. He was a breath of fresh air in guiding many of us in the use of time ownership when there are so many less than honorable crooks within the industry.

            I have not spoken to Katie directly as I prefer written communications when dealing with important matters. People I have found many times do not always remember what they said and will deny things at a later time to avoid involvement.

            Ms Childress was very pleasant and forthcoming early on but has avoided responding to my emails now for a period of three to four weeks.

            If anyone has information which would be beneficial to owners who may be involved and are getting the short end please post it for all to benefit from.

              What to do about money owed?

              Hey All,

              I, too, am still owed over $1200 from last summer's rental through NALJR. I never received the email from Katie Childress (though we exchanged a few emails) but did receive the copy of the email from KCP. I have talked to an attorney in Williamsburg (a couple of weeks ago) about this. He checked court records and he could not find where NALJR had actually filed for bankruptcy which may explain why we have not received a letter from the attorneys for Miss Childress.

              He also stated that he charges $200 an hour and it may not be worth it to pursue anything. However, if we had a group of owners that wanted to get at least part of our money, maybe it would be worth it. In any case, he suggested sending a strongly worded certified letter that threatens legal action to see if we get a better response.

              The thing about dealing with NALJR is that the record keeping was not very formal so it may be hard to make a case (I can't find the rental agreement from last year - even so, it did not reflect the rental amount).

              It seems to me that the distinction between KCP and NALJR was very blurry due to Mr. Lewis and his assistant's (Sondra Barret) both working for KCP as well. It seems as though KCP may have some liability as well...

                  UPDATE:

                  I've filed a complaint with the Office of Consumer Affairs through the Department of Agriculture and Consumer Services in Virginia. Others I've communicated with privately have done the same. So far, no resolution.

                    Official compaint vs NALJR

                    I've also filed a complaint with the Office of Consumer Affairs. They sent a letter to Miss Childress and copied me. No reply as of yet as fara as I know

                      Today I received a copy of a second letter sent to NALJR Inc. I'm going to call the Investigator involved. Obviously these letters are being ignored. What's the next step?

                        Still Unpaid for 2010 Rental and Ignored

                        Thank you all for this forum. I thought I was alone in this frustrating exchange (or lack thereof) with KCP and Kathy Childress. I rented for 2010 (week of August 27 to be exact) and received confirmation that it was actually rented but have not received any of the monies owed me for the rental. Have only been strung along and taken for a fool in believing and waiting that they would do the right thing and pay me what they owe me for my rental. so they get to also keep the $60.00 which they charge upfront to list your rental but they didn't say that they also pocket the rental cost too! Has anyone began taken legal action to get his/her monies owed?
