  • Help needed with timeshare seller companies unwanted calls!

    I made the mistake of calling one of those "we will sell your timeshare for you top dollar guaranteed" businesses that of course want an outrageous fee upfront about a year ago. I never asked to be put on a marketing list nor did I ever consent to any such thing.

    Well for the past year, I have told appoximately 50 different callers that I am not interested and to take my name off of the list they all said I was put on. They each say that they can not take my name off of this list that is sent out everywhere, but they themselves will not call back. I got a name from a supposed list creator company and sent a letter demanding them to remove my name and phone number from whatever list that it is on that is behind all of these different companies calling me all of the time.

    Nothing has changed. Everytime I tell one person to stop calling, I get the same song and dance about how they didn't know, they were just going off of a list that shows I had interest in wanting to sell.

    What recourse do I have? If telemarketers have penalties for calling someone that is on a do not call list than why don't these guys? And if they do, how in the heck do I identify which company is the offender, since I get calls from different companies??

    Short of changing your phone number, I don't think you can stop them.

    When i read your post I realized I haven't gotten any calls in several months, though I think it is just a pause and I haven't stopped them. The calls ebb and flow and they're maybe in a down cycle with the list I'm on.

    Here are a few things you can do. I'm not sure if they help, but worth a try.

    First, sign up for the national Do Not Call registry if you haven't already done so.

    Second, try to resist answering the phone. It will only frustrate you. If you're compelled to answer the phone, politely interrupt the caller quickly and inform them you're on Do Not Call and that you'll report them. (I've had some hang up on me at this phase, so they clearly know they shouldn't be calling.) Ask them to take you off their internal list as I believe you've already been doing. I do report each caller who violates Do Not Call. The fines aren't automatic but I figure as many calls as I get and report, it might get someone's attention in aggregate.

      Register with the National Do Not Call list at https://www.donotcall.gov (and save the info or a link to where you report violations) and also the DNC list for your state. In Florida, it is Florida Do Not Call Program - Division of Consumer Services, DOACS. Again, remember to save a link to the page where you file a complaint for violations)..

      Review the info that you will need for the complaint.. Normally it includes the number that called you, the time and date of the call, the name of the business (if available), and then specific info about the call (was it a robo-dialer, did the caller identify themselves, did they identify themselves as a charity or political party, are you a current customer, etc).

      Remember, if you contact a company- they have a set time period when they can respond to you with phone calls, either automated or by an individual. Also, if you do business with a company- they (and their partner businesses) can call you. Finally- charities and political organizations can call.

      If you consistently report these unsolicited calls, they will eventually be stopped. It also gives the state and federal government another tool to try and shut down some of these scams.

      Good luck.. It will take patience and record keeping- but everytime you fill out a form you'll actually be doing something to stop them!
