    I purchased a floating week at Landmark in Panama City Beach from the Timeshare Company. All fees were paid for this year and I was to have the 2011 week to use free and clear.

    I purchased this around April 20th and got my deed a few days ago. They were very fast on getting the deed and transfer done. But when I signed in to my Landmark account I find that the week for 2011 was deposited with RCI back in February. This was way before the listing.

    They offered me a week in RCI if I had a weeks account, which I do not. I have a points account right now and so they have offered me 60,000 points. I did not plan to use this week in RCI but they said they could not give me my week at Landmark.

    I need to know if this is a FAIR offer or not.

    I would find out what a comparable rental costs at Landmark and ask them to rent you the week. Alternatively, I would hold out for more points.

      This type of thing happens all the time when RCI points is involved.. Unfortunately, not many sellers (or closing agents it appears) understand that RCI often takes the usage far ahead of time. In some extreme cases (Orange Lake as a specific example) there are times when the resort will pre-deposit up to five years into the RCI bank..

      The estoppels used by the closing agent should specifically ask if the seller's account is an rci points account, and if so- additional steps need to be taken to ensure availability will be there for the buyer.

        What is your floating period at Landmark? I only have an RCI weeks account, so I can't go into the system and see how many points, you should be able to get with RCI. But at this late in the year, you probably couldn't get a great week for 2011 since they are taking reservations now for 2012. You could only get a week that was left over and no one else booked in 2010 for 2011.

        I would say that your issue is with the seller and not Landmark Holiday Beach Resort or RCI. Is "they" the seller?

            It sounds like what you bought and what you actually got are not the same thing.

              These floating weeks system are all different. I would find out when you have to notify them the lastest date to use your week.....take what they offer for this year.

                I would ask for the maintenance fees to be returned to you in cash. If that doesn't work, then take the 60000 RCI points. You can rent those to someone else to get your cash. Rent them before the seller transfers them so that you can have them transferred directly to the renter.

                  I tried to negotiate for more points but they would not negotiate with me. They forced me to leave positive feedback before they would transfer the points to my account.

                  I will never do business with them again.
