Galway Bay Cottages IRE - Help with sudden increase in maintenance fee

Latest is they are planning on selling to a UK timeshare developer. Looks like this years maint fees will stand. But next year the new developer will lower back to reasonable levels in order to sell units.
They will be sending out a letter soon.
So, it sounds like good news. We'll see. I still haven't paid yet.

It depends on who the new developer is. You could be out of the frying pan and into the fire! As part of the process, I would suggest that owners band together and demand a member-controlled HOA board.

I am new to this forum and am also a GBC owner. My wife and I were stunned at the increase in fees and cannot afford to pay the maintenance fee. We received an email containing the following concerning our options:

GALWAY BAY COTTAGES LIMITED
Forramoyle, Barna, Galway, Ireland.
Option 1:
You pay all Maintenance Fees outstanding, you or your estate are contracted to pay on a yearly bases the required amount under the Terms & Conditions of your agreement. If you fail to do so we have the legal right to peruse any and all outstanding monies through the legal system.
Option 2:
We as a Company have decided to offer any owners that wish to opt out of their agreement the opportunity to relinquish their week or weeks at a cost to you of 2000 Euros, this is far less than you are contracted for and we believe it to be a fair offer. This will relinquish you of any outstanding Maintenance Fees and any future commitment to Galway Bay Cottages.
Option 3:
Project 9
The pack comprises of you holidaying over the next 5 years at Galway Bay Cottages or around the world with the exchange companies, at the end of the 5 year term you are relinquished of any cost to Galway Bay Cottages and your time share becomes nil and void.
You are asked to pay a one off payment of 3550.00 Euros there after No maintenance fees are required or legal cost would be incurred by yourself.
Please note this is a limited offer due to the logistics of the resort and your 2013 maintenance fees and any other monies outstanding will be waved.
I am sure that you appreciate that my Company as purchased the resort and your agreement at a cost and it would be financial suicide for us to allow any party just to hand their weeks back.

If anyone has any suggestions as to how we can proceed I would like to hear them. Apparently giving back the week is not an option and if we don't pay our maintenance fee they are threatening legal action.

I write to you to discuss you 2013 maintenance fees. We are collecting 2013 maintenace fees and would like to collect these by end of January 2013.
I know some owners had held off paying fees as they were unsure of the future of the resort however I hope we have restored confidence and would like to ask that payment for your fees is made. Your fees can be made by direct bank transfer to the following account:

Can I please ask that when making payment you clearly state your name and unit number? The fees for 2013 are 717 euros or 919 US Dollars however as the previous owners advised this was a one off levy in order to have a new sewage system installed. The fees for 2014 will go back to normal next years.
Should you prefer to pay by paypal using a credit card please email me your paypal linked email address and I can send you an invoice via Paypal.
We do need to collecte outstanding fees as soon as possible,

What they really need to do to restore confidence (and democracy) is end the developer dictatorship on running this resort, and elect an HOA board from the members to oversee its management.
Sloan Gardens Club in London is another timeshare in the British Isles whose owners are mostly American. Those members had a bellyful of developer management, and kicked out the developer, so they could hire their own manager. Things have run very smoothly there ever since.

I would suggest you also lookup in corporate registery the ownership of the company and changes of directors, etc.
Had an issue with another developer that they asked for payments to their for profit company with a similar name to the HOA non-profit company and included name to the resort in their for profit name.Traveling Broadens the mind and I want to do more French Quarter Fest in New Orleans is my favourite festival

We too got hit with the $919 2013 Maintenance Fee. I emailed the new management company when the 2014 maintenance fee was issued.
This was the explanation I got.
2013 was set by the previous owners as a one of charge to cover the repair work to the sewage system, My understanding is that every owner was sent a letter from the McDonough Family explaining this.
We will be carrying out the repairs.
2014 will then be as stated 350 euros and year on year 5% increase.
I hope this clears up any confusion.
350 Euros is $450 US so it seems things will get back to normal next year.
We are now thinking of paying the 2013 (they said they would work with us and take half now and half later) so we can continue to keep the timeshare and exchange with RCI.
Any one else out there thinking the same or want to comment?

Someone really does need to research the legal rights here. Has anyone demanded copies of all relevant legal documents? This ''subsequent developer'' has bought whatever rights the original developer had, but may be asserting more power than he actually has. Is there a provision about setting up a member-elected committee to run the place? If so that ought to be enforced.
Galway Bay seems to have some attributes of Sloane Gardens Court in London. It, too, was developed by Ameicans and sold primarily to Americans. When the management company then running it started cutting quality while raising prices, some members smelled a rat that they were trying to run away members to get the property for themselves. The members called a special general meeting of members, held in Chicago, ousted the management company, and replaced it with a hired manager who reported to an elected board. Everything has run fine at Sloane Gardens since then.

I would recommending checking the corporate registery to make sure there are not separate for Galway Bay Cottages Limited and Galway Bay Cottage PLC. We have a resort which the management company has control a for profit company with the name <resort name> Inc. and the HOA is a non-profit <resort name> Owners Association, Inc. Some money is being funneled into the management company / developer controlled for profit company including rental income.
They also never provided actual information (except very few lines of detail at the AGM) nor breakdown of revenues including rental incomes. It seems that the developer are not paying MF on the units they control/own nor those weeks which are deliquent but keeps all the rental incomes. They also send letters to owners who are behind in MF offering to quit claim the week (persuamably to a developer controlled company) for a fee of $2000 which I persume is earmarked for the developer themselves.
The developer now has 1 of the 4 director seat staffed with his man without a proper election when a previous director resigned in protest to some of developers antics. If another director resigns or fails from ill health, he would likely control the BOD and completely control the resort and can do what he wants with SA and raised MF.Traveling Broadens the mind and I want to do more French Quarter Fest in New Orleans is my favourite festival
