I was on the OBX Saturday at a timeshare where I own a week, and was talking with a fellow owner there who is an HOA board member at another resort. While we were talking the manager of the resort we were at came up and said she had a call from the manager at the other resort, saying some members there wanted to talk to him BUT that he was not allowed to go on that resort's property and if he did he would be arrested so he needed to talk to them just off of their property.
I knew that the other resort had been afflicted since last fall with an HOA president whose temperament was better suited to being the El Supremo of some third world banana republic, but I did not know it had gotten that far. I also had heard that the manager of that resort was afraid to do anything but carefully follow the script given her by that president, so that was the apparent source of the demand for a board member to stay off of the resort property.
When he returned, he said the members who had wanted to talk to him were hot about a very unpopular unilateral decision by that HOA president.
This board member knew that neither the manager not the El Supremo had the authority to order him off of the resort property, but did not want to stir the situation any more than it already was.
I am also aware of the problems that that resort's longtime (but now former) treasurer has had. He had identified a series of serious issues with a former manager who was real tight with El Supremo, brought those to the boards attention, and together with the board member told to stay off of the property took the lead in forcing her out as manager. While the treasurer was still digging on those issues, El Supremo had told the treasurer he no longer had access to the financial records and proceeded to lock those up. With roadblocks to doing his job, the treasurer resigned that position but kept his board seat.
I have also learned that El Supremo has spent $5,000 of the resorts funds without getting board approval to hire a lawyer to try to force out the two board members.
This resort has had an excellent hands-on board for many years, and has historically been well managed. I guess this just shows how quickly an HOA can experience a meltdown with someone on a huge power trip in the presidents slot.
The resort will have its annual meeting in October, and hopefully there can be some changes then. The director told to stay off of the property is the First Vice President of the board, and has served on the HOA boards of a total of four timeshare resorts on the OBX. He was also the board member who was given primary responsibility for hurricane recovery after this resort had sustained major damage from Hurricane Isabel, and using his skills in construction law worked out a deal where the resort was largely refurbished in much better condition than before the hurricane with no need for a special assessment.
