Just had a phone call...…. Profeco Scam!

    We had the same phone call from Profeco. We filled out all the forms and sent them. Then we had to send them a bank account number for the deposit of the money. We talked to the bank about what was going on so they knew. Now they want us to send $5000.00 to activate this account. We will not be doing this. Now we're thinking this is just a scam. They said they will call again today, we'll see what they want this time.

      We had a call from them also saying they were from Profeco. We sent in the paper work but now they are asking for money to activate the bank account, that won't be happening. We think its a scam now. They should be calling again today. We'll see what they have to say.

              They have been calling me non stop as well. I strung them along to see what the outcome would be and then it happened... They asked for an "Underwriting Fee" to verify the account before they would transfer the money. I told them this was not going to happen so then they had another person call me to explain it and she tried every explanation in the book. I finally just said that there was no way I was going to transfer any money into their country for any reason and to quit calling me. Big scam.

                    www.profeco-gob.mx may have been shut down as I just got a forbidden site by this server message. If anyone else can get on, let me know, and I'll contact the real PROFECO and let them know they are being phished by scammers.

                      I wrote an email to Profeco for a friend in Mexico and received a reply and was really surprised as it didn't take that long. I will copy and paste it but removed my full name. It will give you all the information you need to contact Profeco and what to do to speed the process up.

                      There is a name and phone number too from the person who replied. I hope that it is OK to post this here but we can remove it if we have to.

                      I am not going to correct the paragraphs as they are lost or correct my spelling that I didn't check when I sent it. I did it right in front of my friend so was in a hurry.

                      According to the following article, there is a term of 5 working days to cancel a timeshare contract without penalization in Mexico:
                      Article 56 of the Federal Consumer Protection Law states: "The contract will be perfected within five working days from the delivery of, or the signature of the contract, whichever occurs the latest. During this period, the consumer will have the right to revoke his consent without any responsibility. The revocation will have to be by means of warning or delivery of notice, in person, by registered mail, or another method of average reliability. The revocation according to this article, will terminate the contract. In this case, the costs of shipping and insurance will be the responsibility of the consumer." Besides, this right cannot be waived according to the Art. 1 from the Federal Consumer Protection Law, Profeco suggest to send your cancellation request by mail to the supplier to all the Mexican addresses in the contract, since It is every important that you keep the evidence in written of the cancellation notice within the allowed term, it means, return receipt requested. (You may send your cancellation notice by Fedex, UPS or other mailing service company)
                      You may follow up with e-mails and/or faxes however they may not be considered as a method of average reliability and the normal time frame to get a response and / or refund from the company is around 20 days.
                      You may contact your credit card company and dispute the charges if you paid by credit card, sometimes the credit card rules to your favor before the companies does. For Mexico business days will be from Monday to Friday. (Except official holidays in Mexico)
                      WE inform you that PROFECO does not cancel contract but we can assist you if the company does not honor your contract or cancellation request.
                      If the supplier rejects your cancellation request or does not honor your contract you may file a formal complaint with Profeco does not require the presence of the consumer during the mediation procedure, please review the jurisdiction of your contract, since if you contract is not governed by the laws of Mexico, Profeco will not be able to assist you.
                      The Consumer Protection Agency, PROFECO, is part of the administrative branch of the Federal Government of Mexico. The Department of Conciliation Services for Foreign Residents provides assistance towards trying to conciliate controversies for foreign or Mexican citizens living abroad that acquire any product or service from a Mexican supplier. besides, verbal promises will not be suitable in this conciliation procedure.
                      Because of the administrative nature of this Agency, Profeco cannot dictate mandatory resolutions to resolve controversies presented before us; therefore, we cannot force a reply from a company. We assist the parties within a mediation/conciliation procedure; based on the terms of the contract that consumer supplies us. Conciliation is an inexpensive way to settle a problem and keep it out of court. In case that cancellation was not done within the allowed term, Profeco will be able to assist you according to the clauses of your contract.
                      ARTICLE 7. Any supplier is bound to inform and respect the prices, fees, warranties, amounts, qualities, measurements, interests, charges, terms and conditions, time periods, dates, modalities, reservations, and other conditions which such supplier has offered, assumed, or agreed upon with the consumer regarding the delivery of a good or the rendering of a service, and under no circumstance can these goods or services be denied to any person; therefore any charge involved in the transaction must be established in your contract, taxes included.
                      To be able to analyze your paperwork, it is required to submit, the following information:
                      1. Complete complaint form. Description of claim must be done in English and translated into Spanish and we need that you clarify your claim and pretension
                      2. Copy of the ID of the persons who signed the contract (Passport or Driver’s License).
                      3. Copy of the full contract (all clauses and / or recitals)
                      4. Copy of the evidence of payment of the total amounts paid, such as credit card statements, issued by the bank.
                      5. Copy of proof of sending of the cancellation request such acknowledgment, post receipt or note of sending and cancellation letter sent to the supplier, if the case.
                      6. Copy of the document showing the non-fulfillment by the supplier or the refusal to cancel or provide the service according to the contract
                      We inform you that Profeco does not cancel contracts (does not have that faculty)but offer assistance in case that the company does not honor your contract or your cancellation request.
