  • An eBay nightmare...

Vistana's Beach Club 2BR Timeshare Oceanfront Florida
Deeded, Gold Crown, Sheraton, Floating week Item number: 320248790410
    Ending May 15

    *********************************
I am experiencing a nightmare purchase from bogieman200( 8 ) ... I made the only bid and now I feel as though the rest of the world knew a secret of which I was unaware... my purchase price was GREAT ($1)... it is the $400 which the seller wants to collect for unspecified 'closing cost'.... Plus... the seller will not provide an identifying address or telephone number...
Seller will not provide a purchase agreement..unit is not identified in listing by number & week..seller
will not provide copy of deed nor will seller identify recorded deed's book & page numbers..seller
will not identify transfer agent nor will seller use a bonded & licensed service..seller has not paid
current year's annual maintenance fee & therefore, resort will not transfer title..seller will not
use escrow service..eBay online help suggested I not proceed with purchase..

eBay is GREAT when all goes well... but when problems occur, it is cumbersome and a nightmare to resolve... Joe Tragesser... jgtragesser@yahoo.com

So did you send the seller his dollar in cash or did you use a cashiers check?

Real estate trans actions are not binding on ebay. Walk away.

I don't want to sound too harsh, but several concerns you mention should have been addressed by using "ask seller" before you placed your bid. I suspect you didn't think you would get it for $1, and now that you have won, suddenly realize how vulnerable you are to loosing $401.

it is the $400 which the seller wants to collect for unspecified 'closing cost'...
This is mentioned twice in the listing.

. Plus... the seller will not provide an identifying address or telephone number...
He will need to do this before you can send your $1, or $401.

Seller will not provide a purchase agreement.
            Seller should provide something.

unit is not identified in listing by number & week.
This is not unusual; just needs to be on the deed.

seller will not provide copy of deed nor will seller identify recorded deed's book & page numbers..seller will not identify transfer agent nor will seller use a bonded & licensed service.seller has not paid current year's annual maintenance fee & therefore, resort will not transfer title..
            RED FLAG!

seller will not use escrow service..
should have been asked before placing bid.

              Joe

I will walk away since there is no easy way to establish a trust between you and seller.

Could also be that the seller suddenly decided that he really didn't want to sell for $ 1, and wants to tempt you to walk away.

This sounds like my very first timeshare purchase (which was from Bidshares.) Couldn't get information from the seller, found out after the auction that the $375 "closing fee" was to be paid to him for him to fill out the paperwork (this was my first purchase, and I though "closing fee" meant a fee to be paid to an actual closing company.)

After I argued with the guy for a while, he got frustrated and simply transferred the deed to me before I even paid him, just to get rid of me -- at which point I paid him the entire amount of the transaction, including his so-called "closing fee." I think the total was about $800. The deed seemed good; I still have this timeshare.

There's no way to know if this guy is on the up-and-up (especially with a feedback of only 8), but it's not guaranteed that he's trying to trip you off. I do think you're entitled to unit information in writing and a signed purchase agreement before sending any money. You could offer to write up the purchase agreement yourself.
