Intimidations and threats is/are what lawsuits are all about; another way, a ramping up to a new level, of threats and intimidation. It is sorta like when the victim ignores the threats and intimidation, the agressor says, "Hey, ignore me now, you (&$$*(*!"
My mind has been wandering to this thread (oh, that's where it's been off to!), and it occurred to me that when a person threatens and intimidates another person (typically called bullying), they can be sued.
Then, an attorney threatens, harasses and intimidates that person, and gets a way with it. Can anyone else think of another profession that is allowed to to threaten, harass and intimidate people, and get away with it?
I wonder what the divorce rate is among attorneys? Since this thread was started by asking about ethics, I'd have thought your concern was more about your legitimate recourse in dealing with perceived mismanagement of your resort. So what about that? Why go down a path that's fraught with legal wrangling and credit report issues? Ask them to take back the deed or list the week as a Freebie/$1 with a free ad/listing or on eBay. You're already paying the MF so it shouldn't be impossible. Me thinks you're heaping extra trouble on yourself by making this decision emotionally (you're frustrated with the BOD/POA) rather than logically based on dollar$ and sense.

I don't have a signed contract with the HOA. What legal and collection fees are you talking about. All they can collect are the MF. Those other costs are associated with contractual arrangments made and agreed to by bith signed parties.
If the HOA would take off my hands no problem. PCCs get $3500.00(according to this BB) to take a TS off your hands. Many TSes don.t sell on Ebay for $1.00 even where the closing costs, transfer fees and advance MF are included. Look at some Ebay auctions if you don't believe me.
