    We are in the process of adding my name to the title of about 25 TS contracts.

    While in Las Vegas last month, a TS Sales Manager said all we need to do is go to the Clark County, Nevada courthouse, show our title paperwork (which we have with us), use the quitclaim deed forms they will provide us and then my husband quitclaims his interest to himself and me with JTWRS (Joint Tenants with Right of Survivorship.)

    We have a certified copy of his late wife's death certificate if that is needed. We didn't have time driving South but thought we might try this on our return. Is it really that simple?

    The same TS Manager said we could record it at ANY courthouse (which I find difficult to understand). But if so that would make it easier to record our Kauaii, Hawaii TS.

    If it is this simple why do resorts request fees in varying amounts to change title?

    He has 2 Mayan contracts. When we were in Cancun last November we asked them to change them. We also notice they spelled his first name differently on the two contracts. They mentioned a fee and said it had to be handled at their Texas office. We never followed through.

    We arrived in Mazatlan a few weeks ago, went to an update presentation where they checked our 'equity.' It pulled up 2 contracts with the first name correct on both. My name was joint on one but not the other. I will try to go to their Customer Service rep and ask if she can add me to the 2nd contract.

    Where I get confused is all the inconsistency. My husband says Mexican contracts need to be recorded with the Mexican government and that is why they charge. None of the Mexican contracts are deeded like our US contracts. Also, when some resorts are accused of 'over selling' units it seems it can happen because they aren't recorded.

    First, deeded properties need to be recorded in the location where the property is situated. You can't record your Hawai'i deed in Nevada. (Well, maybe you can; I think a county recorder can record any document you wish as long as you pay the fee. But to have any legal effect, the deed needs to be recorded in the location where the property is situatied.)

    Second, you need to be sure of what the local rules and procedures are for creating a JTWRS. Under old rules for doing so (and those rules are still followed by some jurisdictions) what you are proposing would not create a JTWRS. I also don't know whether the applicable rules would be the JTWRS rules where you live or where the timeshare is located. You really need to contact an attorney for help on this.
