  • How do You Define "Owner Controlled" ?

    Much owner aggravation stems from HOA boards that are developer-controlled. So, if one is looking to avoid these situations, what should they look for?

    1. All board members are owners.
    2. No board members are employed by, or otherwise beholden to, the developer.

    Is that enough?

    You don't need either of the stated options for the resort to be 'Owner Controlled'. A simple majority of owners, with voting rights, on the board would do the job.

      There are sometimes owners who are supportive of the developer, as at the Barrier Island Station resorts. I would prefer that the developer not have any employees on the board, and also either not be management or have a management contract renewed at periods of no more than two years, preferably one year.

          As long as the majority of the Board members are elected by the individual owners AND are not employees or appointees of the Developer/Management I consider the Board to be owner controlled. If a Developer does hold a seat (or more) on a Board I expect they are an owner of at least one timeshare or else they should have no place on the Board.

            So are you saying that only owners who are totally opposed to all and any actions suggested by the developer should be allowed to stand on the committee?
            Individual owners are just as capable of coming up with stupid ideas as any developer!

              Now THAT is a true statement. Simply having an owner operated Board does NOT guarantee a successfully run resort but it does give a better chance that its the OWNERS that will be #1 rather than sales/developer concerns. They can still make really bad choices such as underfunding reserves or delaying upgrades, etc. You just have to keep an eye on the Board actions and vote for qualified people to serve.
