Warning about valet parking
It is a summary of a discussion over on the DIS-DVC Boards.
IMPORTANT: Apparently a number of the major car rental companies have made a change to their car rental agreements.
Valet/Parking attendants used to be covered drivers under the car rental agreements. Hertz, Avis and Budget have apparently removed “Valet/Parking attendant” from the definition of authorized driver. Now here is the really bad news. Your personal insurance, the car rental company CDW and other such as AMEX Premium Car Rental Protection all seem to require you to be in compliance with the car rental agreement to be covered. So when you authorize a Valet/Parking attendant to operate the vehicle you have violated the car rental agreement. Therefore any loss when the vehicle is in the control of a Valet/Parking Attendant is the sole responsibility of the renter. And now for even worse news -- the car rental company will be after the cost of damages PLUS the lost rental revenue for each day the car is not in service. And you have to fight this yourself because none of your insurance will cover you. You would have to sue the valet parking operator and/or the establishment and/or event promoter to recover your damages. And the valet/parking attendant almost surely take your car with a disclaimer of any liability for damages or loss.
This is a really bad scenario if you rent a car and use valet or parking attendant garages.
It appears that Alamo still permits valet parking. The following is from Alamo’s frequent renter program:
8. AUTHORIZED DRIVERS: I am the authorized driver if I have a valid driver's license and meet all of your rental requirements. I and the following persons, with my permission, may operate the car: (1) my spouse; or (2) my employer, or fellow employees incidental to their business duties, provided the persons have a valid driver's license and meet all of your rental requirements and are not impaired from operating the rental car. Except to the extent necessary for valet parking or in an emergency as permitted by law, no other persons are permitted to operate the car unless all such persons appear at the time of rental and are named on the Rental Agreement. I understand that all additional drivers must be at least twenty-one (21) years of age except in New York (18), and have a valid driver's license. At our discretion, other qualifications may be in effect at the time and place of rental, which may include a charge for any additional driver or any driver under twenty-five (25) years of age. ALL OTHER DRIVERS ARE UNAUTHORIZED. Not withstanding anything herein, I am always responsible for any losses or damages caused by any driver of the rental car.
Looks like Alamo just became my primary car rental company.
