Then THEY are on the hook - not you - and chances are you'll be cleared soon after. Don't pay them anything more & let them come after you - especially if you sent that rescind notice. Until they prove you didn't there would be no harm done - if they win then you can propose a settlement then & still have no problem with your credit report(s).
I know this is troubling to you but if you rescinded within the X days required per the instructions they had to give you in your paperwork then no mater how many times they threaten or don't respond to your inquiries doesn't matter. They have nothing to come after you for. If you sent that rescind notice just sit back & wait. Get some rest. Don't worry about it. They can't do anything once you rescind per the rules.
If you DON'T have proof you sent the rescind letter on day X or before then try to settle with them. Offer a flat amount you can live with as full & final payment on their providing a notarized release of all current & future payments in return for $XXX (whatever you agree to). Then get that release - give them the agreed upon amount & forget it as a bad experience never to be repeated. Just don't knuckle under & pay unless you really have no other option. That usually isn't the case as they will let you settle for a reasonable amount upfront. Good luck.

Thanks for your reply, I was one day late to send the rescind, i send it on 6 th day early morning as by the time i realised i should mail it back the fedex was abt to close, but i did put my card in dispute and also emailed the the sales director and the related person with signed and scanned copies of the contract by email, which they do not accept. however, after on/off threatening emails of settlement i got a letter from eldorado saying....
" [please be adviced that you are in default of your obligations under the contract. as a result of the default, i regret to inform you that the developer intends to exercise all or some of its contractual rights: include but not limited to: 1. the right to declare the contract cancelled.
2. the right to retain any and all deposit made by you. 3. the right , in accordance with the terms of the contract, to enforce the promissory note executed by you in connection with your purchase. and they gave 2 phone no to contact.
I hope somebody will help me understand this and take careful steps accordingly, i want to know what they can do further and how it may affect me and what i could do to avoid them... please help somebody to deal with this mess. dear timesos2, You seem to be really knowledgeable abt this timeshare...please advice me for how to deal with this issue.. thakns a lot.

Not specifically about this timeshare but timeshares in general.
You've done what you can. Just DO NOT pay one red cent until they have an offer to you to end the obligation. If you won't give up a dollar and you use the minutes that you missed the deadline by as proof you tried to cancel they will eventually understand they will not be getting much from you.
Then you get an agreement that you'll give them XX dollars or maybe the down payment amount to end all future obligations. Not a penny to them until they give you an out. Stick to your guns and you'll win. Good luck. Stick with "Nothing until you end the contract".

You can stop paying, they will take it back, HOWEVER you will have black marks for defaulting on a mortgage.
I have so many letters from the same resorts, these guys are the 2000+ mafia, they have you over a barrel as you signed the paperwork. In the UK / Europe its illegal to do that (same as Canada where i am now i have also learned).
