orange lake resorts class action lawsuit

  • mis-sold

    we purchased orangelake florida a few years ago were told this and that what a load of rubbish we were told.swap to any other resort through rci between $25-$50 we phoned up for vegas cost us £400 to exchange contacted orangelake guess what they didnt have any detail of it.phoned to say missold by the rep as told alot of rubbish told that rep dosent work here and its your word against his told them i had another 4 adults with me that day who can vouch for me she said she would get someone to call me still waiting and they dont reply to emails.
    i contacted timeshare consumer association and they sent me an email i have added it below we are now just paying the mortgage at the moment and not paying there maintence fees and once my wife starts her new job we are stopping the mortgage payments as they keep harrassing her at work.
    i contacted them through email to saying i was going to look into a tv company looking into this for me that was 2 months ago and still no reply.




    If you decide that you want to stop paying the annual fees – and cancel the ownership - for a timeshare in the United States then write, by “International Signed For”, bluntly telling them:-



    a. I/We were told a pack of lies to get you to purchase = misrepresentation . [See TCA - Misrepresentation for examples]

    b. Your fees are exorbitant and are probably illegal

    c. I/We are cancelling our membership forthwith.



    Then stop all annual fee payments and TOTALLY ignore any further correspondence.



    Although they will almost certainly threaten legal action (and get their local debt collectors to threaten) we have never known any UK citizen being taken to court in the UK by a US based timeshare operator. Eventually you should receive a claim from their local County Court in which the resort is claiming repossession – which is exactly what you want. Totally ignore this claim and allow the repossession to take place.

        we are Orange Lake owners since 2002. since then Everything has changed for the worse. we have 2 fixed weeks and initially the maint fee was 441.00 per week, now we are up to 800.00 a week. We are threatented that "forclosure is in our future" for the fact I AM SICK OF PAYING NEAR 2000.00 a yr with RCI and exchange fees. I decided to look at our contract. Well to my surprise on the back fine print it states we agree to pay 441.00 a week. there is nothing at all saying we agree to pay whatever they say we should pay. so this is a CONTRACT that both parties must honor. HMMMMMM.. if anyone knows anything about this PLEASE help. wow just think what a 2000.00 vaca would look like

          Sorry to hear you are unhappy with your ownership.
          How long have you owned your weeks?

          $441 seems like Maintenance fees for 10 years ago.
          The MF's can't stay fixed at $441 when everything else goes up or the place would never be updated and would fall to ruins.
          $1600 for two weeks of vacation in a resort is still a little over $100 a night.
          It's not a giveaway price but still a reasonably priced vacation.

          You don't have to trade your week if you don't want to pay the RCI fees.
          You could join some of the alternate exchange companies for free and see if they would work better for you than RCI.
          Some of them are Platinum Interchange, Trading Places International, DAElive, SFX-resorts and Holiday Inn has their own internal exchange system.
          You may have better luck with cheaper vacations thru these other options.

            While this is true major companies screw up the legal language in contracts all the time. IF your contracts says that you maintenance won't go up, you should talk to a lawyer and have them review it. If the lawyer agrees, I wouldn't pay a dime over $441

                  • Hi. Also from England. First purchased in 2009 but same problems with RCI. I can't get anything I like in Europe and much as I love the USA, I can't go there every year. I was lied to basically by the salesman. And after going to Orange Lake last year, a meeting set up to discuss my grievances was another sales pitch ! I upgraded my package under the assumption I could exchange my points for IHG points, which I can use. But they failed to tell me there was a cut-off date, which I missed by 4 days. So, I've stopped my mortgage payments and the ball's in their court. I believe that Florida law is unforceable in the UK except for a criminal, not a civil matter. We'll see. I wish I'd never got involved in the first place. All for a free ticket to Disneyland !

                      Sorry to hear that. I feel for the many who have dissatisfying timeshare experiences, and are forced to continue having them.

                      For the later arrivals, OLCC has always been a bone of contention on these internet forums. LOL v. everyone else. DW and I were there on our very first vacation together, and it was our very first tour, when there was only what is now the West Village, and not much of it, the week we got involved in timesharing. We have been back several times, including the last time we took the extended family to Orlando, a 3-bedroom in the East Village Christmas Week.

                      Sorry, there's likely nothing you can do to recover anything, but be thankful you are outside their grasp, if that proves to be the case.

                        The thing is, I love the resort. But the sales pitches were clear cases of misrepresentation. Sadly, I would imagine that eventually the worst-case scenario would be the rejection of any future Visa applications due to a court judgement, which would be a shame. I've tried to suggest a compromise in that if they transfer the points to IHG and a set timespan can be agreed after which my commitment finishes, I'll continue with the mortgage payments. I know that foreclosure is a messy business and a last resort for them.

                        But so far they aren't listening.

                        • and so far that is SOP, standard operating procedures.

                          Even in Florida, with an AG purported to be tough on the vacation industry, the sleaziness of timeshares is considered perfectly legitimate. They will go after the operations that exist because of that sleaziness, but not the sleaze that caused them.

                          Even if you are told something that is 100% true, in time it likely won't be, so you wind up with a legal commitment to something you never agreed to.
