  • Boutique Resort La Jolla Mazatlan are Criminals !!

    In December 2009 my wife and I attended a time share presentation at Boutique La Jolla, Mazatlan Mexico. We own time shares already and have been looking for a means to convert our weeks in RCI to points as the availability to exchange seems much greater with the points system.
    The package presented seemed exactly what we needed. We would be able to sell off our “weeks’ unit and buy a Fractional “points” time share with a value equivalent to one week at high season at any RCI resort in Mexico. They offered financing but we opted to use our own credit card to pay the balance owing on the contract - $8900.00. Other incentives were offered to sweeten the deal frozen maintenance fees and a 100 year membership in HSI another vacation club.
    After signing we were unhappy with the fact we couldn’t get a straight answer about the tradable value of our newly purchased points. We checked the web and found MANY unhappy people with their dealings with Boutique Resort La Jolla, Mazatlan. We were aware of the Profeco rules allowing cancelation of any contract in Mexico within 5 days of signing for any reason. We decided to cancel the contract as it was now only 1 day after signing. We went back the next day to speak with Frank Convenuto the Sales Director at La Jolla to request verbally and in writing our contract voided. He said it was out of his hands he refused to refund our money and to speak to Profeco. We did that same day file with Profeco at their office in Mazatlan notarized copies dated stamped by profeco stating our wish to cancel the agreement and sent to the resort via registered mail.
    When we returned from our Vacation our Credit card company Capitol One Canada agreed to refund our purchase. Two weeks later the resort resubmitted the fee and once again we were out $8900.00
    Shortly after our return we also received an email from Profeco asking to submit all the paper work. We had previously done this in person at the Profeco office in Mazatlan but as requested emailed scanned copies of all papers again. Several days later I received an email from Profeco stating the copies were not legible when printed and to get in touch with them. I emailed then back stating the papers were on route via registered mail. Profeco emailed me back requesting we contact them within 5 days stating our intentions. I once again emailed them with our plight and again informed them the papers were on route via registered mail. Profeco emailed me this last time informing me pursuant to Mexican Law the file has been closed due to non communication from us.
    It is now 3 months since this began with not one communiqué from the resort. I have followed all the procedures set out by Profeco in the time frame they requested and now they refuse to return any correspondence from me as well emails are not returned and phone calls only get no answer or busy signals
    The Boutique Resort La Jolla Mazatlan has not provided what they agreed to in contract.
    Profeco won’t help, The Credit Card Company won’t help
    This is not a Merchant / Customer contract negotiation issue as Profeco might suggest it is out and out Theft to the tune of $8900.00
    Charlie Lizar the CFO of Boutique Resort La Jolla, Frank Convenuto the Director of Sales at Boutique Resort La Jolla are not just dishonest sales men THEY ARE CRIMINALS hiding behind the small print of a bogus agreement.

    We too were scammed by La Jolla

    Our plight with the criminals at La Jolla go back to Dec 2008. Lot's of broken promises and agreements and a customer service attitude not to be believed. They are crooks. We even had things in writing they later said they would not honor because the sales guys who wrote it was no longer there. BEWARE BEWARE BEWARE. La Jolla is a scam and they have not even built the condos they swore would be on the beach front in 2009.

              What did it take for that to happen? Please share so that others might benefit. These crooks should not be allowed to continue this practice. I am considering contacting the Attorney General of California.

                What or how did you negotiate with these guys? I have a problem also with them and what they promised is not working out.

                  We got what we bought.

                  We are two of the very few La Jolla owners that got what they bought and are happy with it. We did not buy points - we bought a fixed month 2-bedroom villa unit that overlooks the pool and beach. We went last year and only the 8 villas were completed and we were the only people there. We did not mind - we loved having our own private resort and are going again this year. If we are the only people there, we will just enjoy the sun, pool & beach. We do not go to visit with other people - we go because we love the town and beach that the resort is located on. We have confirmation for our reservations and will be driving to Mazatlan from the Phoenix area.

                    More scamming by La Jolla Boutique

                    My husband and I also were scammed by LA Jolla Boutique. The conversion contract (from weeks to points) was supposed to be a contingency agreement---the sale of another time share we own needed to happen through a timeshare resale company partner if La Jolla. Later we found out that such agreements are illegal.. La Jolla holds all the paperwork on THAT part of the contact. How foolish we were...no one needs to tell us that now! ALfredo Macq was our salesman; he will not reply to our e-mails. Ed Chester, the salesman who sold us the first contract, is no longer associated with La Jolla and won't respond to our e-mails. After reading numerous Internet postings about irregularities involving LA Jolla Boutique contacts, I would advise people not to enter into ANY contract with this resort. Go and stay---it is quiet but lovely. Go and listen to the sales pitch and walk out with whatever they have offered you---but do not buy!
