In December 2009 my wife and I attended a time share presentation at Boutique La Jolla, Mazatlan Mexico. We own time shares already and have been looking for a means to convert our weeks in RCI to points as the availability to exchange seems much greater with the points system.
The package presented seemed exactly what we needed. We would be able to sell off our “weeks’ unit and buy a Fractional “points” time share with a value equivalent to one week at high season at any RCI resort in Mexico. They offered financing but we opted to use our own credit card to pay the balance owing on the contract - $8900.00. Other incentives were offered to sweeten the deal frozen maintenance fees and a 100 year membership in HSI another vacation club.
After signing we were unhappy with the fact we couldn’t get a straight answer about the tradable value of our newly purchased points. We checked the web and found MANY unhappy people with their dealings with Boutique Resort La Jolla, Mazatlan. We were aware of the Profeco rules allowing cancelation of any contract in Mexico within 5 days of signing for any reason. We decided to cancel the contract as it was now only 1 day after signing. We went back the next day to speak with Frank Convenuto the Sales Director at La Jolla to request verbally and in writing our contract voided. He said it was out of his hands he refused to refund our money and to speak to Profeco. We did that same day file with Profeco at their office in Mazatlan notarized copies dated stamped by profeco stating our wish to cancel the agreement and sent to the resort via registered mail.
When we returned from our Vacation our Credit card company Capitol One Canada agreed to refund our purchase. Two weeks later the resort resubmitted the fee and once again we were out $8900.00
Shortly after our return we also received an email from Profeco asking to submit all the paper work. We had previously done this in person at the Profeco office in Mazatlan but as requested emailed scanned copies of all papers again. Several days later I received an email from Profeco stating the copies were not legible when printed and to get in touch with them. I emailed then back stating the papers were on route via registered mail. Profeco emailed me back requesting we contact them within 5 days stating our intentions. I once again emailed them with our plight and again informed them the papers were on route via registered mail. Profeco emailed me this last time informing me pursuant to Mexican Law the file has been closed due to non communication from us.
It is now 3 months since this began with not one communiqué from the resort. I have followed all the procedures set out by Profeco in the time frame they requested and now they refuse to return any correspondence from me as well emails are not returned and phone calls only get no answer or busy signals
The Boutique Resort La Jolla Mazatlan has not provided what they agreed to in contract.
Profeco won’t help, The Credit Card Company won’t help
This is not a Merchant / Customer contract negotiation issue as Profeco might suggest it is out and out Theft to the tune of $8900.00
