i got scammed into a timeshare

  • i got scammed into a timeshare

    after getting home from vacation i realized i was scammed i tried cancelling my timeshare i got in las vegas but they said i am to late that i had only 5 days to cancel wish i wasnt aware of..so then i called timeshare advocacy int. and they are charging me $1,995 upfront to start the process of cancelling the timeshare they said this will cover everything and it will be as if i never purchased it.it will not go on my credit or it will not be a foreclosure..

    is this the right way to go?

    is there anyone cheaper out there? and trustworthy? i dnt know what to do

    You shouldn't have to pay anyone to rescind. If you were within the waiting period, it probably only needed a certified letter canceling the contract. Check your contract, you may have more than 5 days to rescind. Then follow the instructions to cancel

      i just missed the 5 days

      i only had 5 days to cancel wish i wasnt aware of, until i tried to cancel it..they told me its to late..so im looking for help...

        Did you yourself read the contract? make sure it's only 5 days. What state did you buy in?

          las vegas and i wasnt aware that i had 5 days to cancel it until i got home and called them, they said i cant cancel it that it to late.. so thats when i started looking for help and found timeshare advocacy internatiional online, but dont know if this is a good idea

            What exactly did they state they are going to do for you? I would probably try to get my money back from them. Even if they offered to sell it for you, never pay an upfront fee.
            If you definitely are past the rescission period, then please read the forums and learn to use the timeshare. I paid retail for my first timeshare like many others.
            I bought it because I wanted to go on vacation more...now I own many weeks and vacation as often as time allows. In other words..you may have spent more money than you wanted, but if the fundamental reason you bought it in the first place is the same, then enjoy it.

              i agree with ^ either learn to use the timeshare or look for a transfer service that doesnt require any upfront fees..sorry for ur ordeal though, but maybe this is a good investment for you..how often do you go to las vegas? maybe keeping it will work out better for you in the long run.

                Before you do anything else, read that contract. Find out for sure what rights to recission you have. Do not rely on what they SAY, what is in writing is what counts.

                  Las Vegas is 5 calendar days. When you sign the contract? usually you need to create a letter just say you don't want it, sign the letter, send back The notice of cancellation by certified mail or telegram to the business address of the developer.

                  I heard a lot of small entities doing that claim that they can get rid of it with a front charge. Seldomly see creditable people report it is consistent working. Most people claim it helps are from the same companies.

                    A few minutes with google suggests that, if you bought the timeshare while you were in Nevada, Nevada law provides only for a five calendar day rescission period. The advice to *read* the contract is still good advice, but I'm afraid it is likely to confirm what you were told.

                    In that event, you are know the proud new owner of a timeshare, and there's probably not much you can do about it.

                    I don't have any first-hand knowlege of TAI, but in the timeshare universe anyone who asks you to pay a non-trivial up-front fee often does not have your best interests at heart. There are exceptions, but there aren't many of them.

                    As for whether or not you can get out of your agreement---you have an uphill battle. It is true that timeshare salesmen say things that are often misleading. But, most of them are very careful to never say something that is provably false. What's more, the contract usually has an acknowlegements page, right on the front, where you initial a clause that says, in effect: "I am not buying this because of anything I was told verbally; only what is in the contract counts." The people selling timeshares have been doing this for a long time, and they generally know what will and won't get a sale voided after the recission period ends. That's not to say you absolutely can't void the sale, but I think the chances are low, even with legitimate assistance.

                        My take on this, just from the way it was written is that the contract was not read and the initials were put on it wherever the developer needed them if there was ever a contract (read on). We welcome our new member/owner and caution her on sending anyone $1995 that she will probably never see again while still being the proud owner of whatever it was she bought, has she told us who the unscrupulous developer was or is this only an ad for TAI?

                        That's some wonderful info about resale scams but this was most probably a developer purchase if it ever happened.

                          thanks for the advice..i am so fusturated and desperate i went ahead with a company called txxxxcom he will cancel everything for $800 as if i never purchased it..it will be off my credit and no foreclosure ...well this is what he promised so ill see what happens.

                          i may be a fool again but im not that smart in the first place to do things on my own so i need to pay for someone to help me

                          he said it will take a while to stop everything i need to write to the resort first and he will help me fight..

                          if it all goes wrong i will post it in here and if goes well i will post it

                          im taking a risk i know but this is how fusturated and desperate i am for help...

                          i will either be screwed again or glad i did it
                          you can bash me for this but this is all i can do for now..

                            Well, I wish you well with your efforts. If in fact they can help you, let us know. There are many people who feel the way you do after they buy a timeshare from a developer. Again, if all else fails, come back and learn how to use your timeshare. Best of luck!

                              You are lettting frustration rule your actions.

                              I don't know what to say at this point as you are bound & determined to "keep throwing good money after bad". This is not bashing, it is what it is, but you seem to insist on being taken again.

                              The Attorney General is your best bet and there is no charge. You will have to do some paperwork and legwork, but that's free.
