  • GeoHoliday Club - Rescind Help

    Hi

Just signed up for this board today. My wife and I just got back from Vegas and I am ashamed to say I got suckered into buying a Time share with GeoHoliday Club/Jockey Club. I have done alot of research the last 2 days and found out that I was sold on a bunch of half truths and ommissions of additional fees that I would have to pay.

I am definitely exercising my right to rescind and I found alot of useful advice on this very forum but want to make sure I am doing enough to get the job done. We signed the contract on Thursday April 19th so we have 5 days to rescind. I am sending it out tomorrow Monday April 23rd via certified mail with signature confirmation. Does the letter have to be received within 5 days of the signing of the contract or just postmarked. I wasn't sure if I needed to send it overnight.

Enclosed in the envelope I am sending the Revocation Form(copy of) that I found in the paperwork as well as a type rescinding letter and also a copy of the first page of the contract.

It says I need to send to:
    Starpoint Resort Group
3700 Las Vegas Blvd South Ste. 200
    Las Vegas, NV 89109

Do you think I need to send a second copy of letters somewhere else to be safe? If so any suggestions?

I also have the e-mail and efax number of the guy that did all the paperwork with us, should I send him a copy as well to go along with the certified letter?

Sorry for all the questions but I just want to make sure this thing is taken care of correctly so I am done with it as I don't want to have to involve a Real Estatate Lawyer if I don't have to but will if need be.

Thanks for the long read and looking forward to suggestions.

    Thanks

    Jeff

I found a Revocation Form in all the paperwork, so I am going to fill that out as well as write a rescinding letter

    Jeff,
Follow the directions exactly as stated on the Revocation Form.
If it says to send it certified mail, do it.
If it says to send it overnight, do it.
And if there is a post office that is open today, go TODAY and send it.

Generally the rescinding period is business days - read carefully and follow exactly.

That said, I would also fax everything to everybody, but that is just me.

      Thanks for the response Pat.

The Revocation Form says to send Certified Mail so I will do that, but also am going to get a signature request as well or do you think that is overkill.

I only mentioned sending overnight in case they actually had to have it in there hands by the 5th day but it just has to be postmarked by the 5th day correct?

I will fax it to the one fax number I have for the one guy as well.

If it says to send certified then do it.
Does it say they have to have it on day 5?
It is more important to pay for tracking (delivery confirmation) of the certified mail to prove it was delivered then ask for a signature.
I have heard stories that at some of these companies, 'regular' employees are not permitted to sign for mail/packages and this could hold up your delivery.

          It says

"This revocation must be delivered personally or sent by certified mail or telegraph to:

          Starpoint Resort Group
3700 Las Vegas Blvd South Ste 200
          Las Vegas, NV 89109

within five(5) days of signing the contract."

So I signed in the afternoon of the 19th, so the 24th would be the fifth day and I am mailing it tomorrow on the 4th day.

Thanks for the tip on the delivery confirmation, that makes sense about not going with the signature confirmation.

So by mailing certified mail tomorrow, you will be fine.
Keep copies of everything.....until you hear back from them.

                  Pat,

Do you know how long it usually takes to hear a response and/or get the refund. Per the USPS site my letter was received last Wednesday and actually last Thursday as I sent two to be safe.

                  Thanks in advance

                  Jeff
