  • The closing nightmare

    I have finally thrown in the towel on believing that the Marriott shadow ridge EOY i purchased will materialize. I have heard literally every excuse, cept the dog ate it, through Solutions in Time(and other aliases). I purchased this on ebay almost 5 months ago.
    Calls to the office, emails, still more excuses.
    I have contacted ebay. Sent a report in to the BBB and fortunately( i think) Discovercard is putting a temp reversal of funds until this is resolved.

    Just wanted to make those aware that may be considering doing business with them.
    Even though their feedback looks fairly good, they have had 39 complaints submitted to the BBB.

    Solutions in time- how many deacdes ? I once sold the story that the boss's dog ate all the checks in the safe that morning and payment would have to wait till they could be replaced.

      You might want to consider contacting the Attorney General's Office of Consumer Affairs in the state that they're located and file a complaint.
      If you did transactions via the USPS, this may qualify under "mail fraud".
      Hit them with these two scenarios and follow up on by contacting the appropriate offices. That may light a fire under them.
      Go get 'em.

          Bill,
          You're welcome. I'm just a second year law student majoring in Health Care & Biotech law, however, I did a semester in consumer law (required) and it was informative and helpful.
          Sometimes, just the threat and proof of follow-through can work wonders.
          Sad that we have to resort to this in order to receive what we honestly negotiated for.
          Please keep us informed of your status.

            I downloaded the forms and attached all the info and sent off to the atty Gen. today.

            Yes, it is a shame that everything gets bogged down and causes more forms and rules due to a few dirt bags.

            I also saw some form IC3 for internet crime I'll send out. I may have to quit my job to send out all these forms.

            Ebay couldn't help...Past the 90 days.
            Discover card put a temp credit on my card but I'm not sure what that outcome will be.

            Paypal is involved waiting for resort travelnet's response AKA Solutions in time.

            But anyway, thanks again for the Legal suggestions. My next step might be when I go to vegas in March, to hold them hostage in the office of theirs ( vegas) or maybe I could get Fern to soap their windows every day for me or something.

              Word-of-mouth advertising, both good & bad, can make and break a company.
              Taking your experience publicly could save others and pressure them to do the right thing. As long as you describe exactly what happened, without embellishment (doesn't sound like you would need to, anyway) there would be no libel countersuit.
              Then again, your idea of loosing her on their windows might be more effective. Or you could call and order 25 pizzas sent to their office daily I gather that they're located in Las Wages ?

                OK Urple2, I think I have you beat.

                My closing is going on 3 months and 6 weeks ago was told that the deed had been prepared and was in the mail to SoCal to be recorded. So I've been looking on the County clerk web site to see if it was recorded. Today, I saw a deed with my name and check the details. It had by name but with my DW middle name. So I called SoCal and was told that the person was not me but someone else with my name (different middle initail). I ask the clerk how long their back log was and she said they didn't have any back log. That all deeds are recorded within a day or two of arrival. She looked and could find anything with my and wife's name at all. Nothing saying they received it but had a problem. Nothing at all.

                Called the closing company and the women doing the closing isn't there anymore and not sure when her replacement will be able to look into the problem.

                  Nah, rookies both of you !
                  My Hyatt Hacienda del Mar (Puerto Rico) took over a year to close. Things move slowly in the tropics. To add insult to injury, I could not purchase this by myself. As a married woman, my husband had to sign (notarized signature) in order for the deal to go through. This is Napoleonic Law which is alive and well in the P.R.

                    Update:

                    Had email awaiting tonight from, you know who... that the deed was rejected by the county because the signature page is incorrect...
                    Well,I dunno...least there is still i guess some hope and communication.

                      Yes, in the end, patience prevailed. I had to invoke a legal threat (nothing I learned in school, but on Puerto Rico's Ministry of Justic web page !) to get things moving. Hyatt was sympathetic, but not helpful as I did not buy it from them. The upside of this whole Herculean endeavor was that the week and closing cost ! $3,600 ! Hyatt had originally exercised their ROFR, but then reversed themselves. Sweet ! Anyway, it's been mine for a couple/few years now and it's a tiger trader.

                      Hyatts, for my needs, are the best. I've only stayed at Hyatt Hacienda del Mar in Dorado, P.R. and the Hyatt Coconut Plantation in Bonita which is incredible. No, haven't done the Keys, yet, but that's near the top of my list once school is done.

                      Hang in there especially if you have a good deal. Some "legal leanings" and posturing might ignite the flame under them. Yes, getting the deed right is tantamount in getting "the deed done" (pun).

                      You'll do just fine.

                        Well I heard back from the closing company. They said that they had 2 files with buyer with my name ( different wife names). Somehow they got the info all intertwined. So when I called they would give me info from the wrong file. ( this is all such BS)

                        They said that they needed a new signed document from the seller and would then be sending the deed to be recorded. (I will not hold my breath)

                          Just a suggestion, I'd say something like , "if you can't get this resolved in 30 days then perhaps the A.G.'s office can be of assistance".

                            Well, the deed arrived, so I am awaiting for Marriott to recognize me as a member. They say about 6 weeks for the resale folks...

                            The seller/closing company seemed a little rattled when they were contacted by the BBB and asked if I would pull the complaint. They even offered me a vegas vacation, but I'm already booked for March. Gee, wait till they here from the attorney general's office.

                            In any event, things are looking up.

                            Thanks for the suggestions those on here provided me. I appreciated it greatly!

                              Sometimes you have to rattle their cages for results. Did you really contact the AG ? If so, good for you !
                              Pull the BBB complaint for a Vegas Vaca only for a time convenient for you. Play hard to get.
