  • Buyers Remorse Shell Explorer Trial

    Hi.
    Another remorseful newbie here, although we did not bite on the full-blown Shell Vacations Club membership last month (Kona, HI). We did however, sign up for the Explorer $2K trial 6000 point package, with only about $190 down.

    After we returned home, both of us looked at each other and were ashamed at our gullibility after surviving the $10K presentation. Now due to economic uncertainty with our employment, the price of fuel, plane fares, etc., we do not want to move forward with this venture.

    The dilemma is now this: 1) do we pay it off and hope everything will work out? or

    2) do we just walk away from our downpayment and go into default on the agreement? (The agreement states that they may use any remedy allowed by the Explorer rules- don't see anything about default in the rules. Also they will cancel the agreement and keep the amounts paid to pay the Seller for default.)

    Right now I’m seriously considering default and give up our down payment. The first payment is due next month.

    I do not see anywhere that this would affect your credit rating in any way. Am I naive? From the agreement: “This is not to penalize you. Instead, our agreement and intent is to agree on the amount of the Seller’s damages now because it is very difficult …to figure out the damages that the Seller will suffer if you default. If this happens then your membership will end and your Explorer points will expire.

    Yes, they promised the moon, but I really do not want anything to do with this group and their high maint. fees after reading some of these threads.

    Anyone bail on this deal that you know of? Help!!!!

    Guess that no one here has the exact experience you're asking about. If you willingly signed for their 'exit program' and they didn't use any illegal coercion to get you to sign, they are probably in their rights to send collection after you which will affect your credit. Will they, don't know.

      I agree with Spence..if you signed something stating that you agree to take their mini package, I dont see why they wouldn't come after you for payment.
      It could ultimately affect your credit if you do not pay.

        I just did the same stupid thing. I am going to go through everything and try to get out of this. I SO regret signing up for the explorer program.

        Did you come up with anyways out? Will they let you cancel if it's been less than 24 hours????

        I'll log back in frequently to see if you have responded. Buyer's remorse if the WORST.

          You are with in the grace period but you better work fast. Read your contract and see what needs to be done for so you can Rescind. Most times you will need to mail a certified letter with in 3 to 5 days.

            I found a part of the contract.. there is a 7 day grace period!
            Yahoo! So relieved. Thank you.

            I will cancel tomorrow, first thing.

            Do I have to give back my 2 nights in Napa that they used as an added incentive?

              Be grateful you are in your rescind period. You can't have your cake and eat it too in this situation.

                If the deal was that u went to Napa to hear the presentation and you DID go to the presentation then no, u wouldn't have to 'give it back'

                If they gave u the stay for free/lower cost BECAUSE you bought the 'starter' package then yes, you would have to pay them back.

                If they gave u 2 nights in Napa in the future because you purchased this starter package then YES, you would not be entitled to the future trip.

                  Update-No Remorse now

                  From the pertinent advice given here, we kept and are using the Shell Explorer points. Yes, the economy took a nose dive and yes, I was worried about my job. However in June we took our first trip to the Whispering Woods Resort in Welches, OR. Fantastic! Thoroughly enjoyed ourselves for five days, with a road trip in several directions.

                  My frugal wife was most pleased with the ability to buy groceries and make breakfast and dinner at the condo. Saved a lot of otherwise spent money on dining. Overall it appears that all of my fears were indeed unfounded.

                  Not sure if I would step out and purchase the package again due to the short time frame of use, but we will definately look toward renting points in the future.

                    Glad it worked out. We've stayed at Whispering Woods in the past and enjoyed it. I didn't realize Shell was now involved there.

                    We also enjoy the cost savings from having the kitchen and preparing our own food.
                    “Maybe you shouldn't dress like that.”

                      Actually, that contract cancellation or rescission period is a mandatory matter of state law --- and its' existence must be made known to you in writing within the contract --- by law. The "grace period" most certainly is not any sort of voluntary act of kindness or benevolence on the part of the developer. Legally mandated rescission time periods vary from one state to another. The shortest anywhere is 3 days (in several states). The longest is 15 days (Alaska, and this is an unusually long time period). Florida is 10 calendar days. In most states, generally speaking, it's 5-7 days.

                      In any case, follow the cancellation instructions provided precisely. If the instructions say use certified mail, that does not mean you can instead opt to use FedEx, UPS, e-mail, fax, or carrier pigeon.

                      Congratulations on dodging an expensive and painful bullet.
