      You would think I would but I don't....maybe Larry would know???
      I own a Marriott so it is coveed by the Marriott USA rules...I think many of the TSs there are part of US based companies.....

        I received email from salesman today. I looked through paperwork. We have no articles, but we do have a document titled "additional terms and conditions" located on the reverse side of the purchase agreement. No where on either side or the agreement or additional times is anything mentioned about rescind, cancelation, etc.

        There is a document titled "owners check list". It has been brought to my attention that item 14 states "I understand that cancelations are not allowed under any conditions and all monies received are non-refundable." As we did initioal this line and sign the document, does that still make it binding? I know there are many things that you can write in a contract, that even if signed does not make them binding.

        Enclosed is a copy of the of the email I received from the salesman today:

        I am in receipt of you letter dated September 15, 2008.

        As I said on the phone today, September 18, 2008, there is
        no rescinding of purchases in Aruba (see item 14 on your
        owner's check list that you both initialed and signed).

        Glenn, you told me that you had gone on the internet
        before we meet and had read about Caribbean Palm Village
        and were pleased with what you read. I kinda thought you
        sold yourself.

        In response to your concern about demand and tradability,
        I received this week my most resent 2 for 1 letter from
        Interval. The trading code is OM9BCD5116. Obviously
        Interval would not be issuing double week redemption if
        our demand was not high. You can call them at 1 800
        828-8200 to confirm this.

        I hope after this buyer's remorse period passes you have
        many years of happy trading and vacations through Interval.

          if you pay by credit card, dispute it. You need send the copy of your contract and the email and your rescind letter to Aruba Government. I am not sure what it will be, but you may want to visit their government site and search for TS.

          But you have cancelled it.

            That will depend on what the laws are in Aruba. In many locales, waivers of rights rescind are prohibited, and signing such a waiver has no effect.

            You might see if your contract specifies the jurisdiction under which the contract will be enforced. If it is to be enforced under Aruban law, I don't see how they could try to enforce a judgment against you using US courts. And if the contract does say it will be enforced using the laws of some state in the US, then I would think that any waivers provided under the laws of that state would apply.

              I certainly hope you are able to rescind. If not, find out ways to enjoy using it.
