    Resolved my dispute with la jolla

    I have read all of these posts about people being swindled by the crooks at La Jolla. Here is a re-post (from another site) of my experience. I feel very fortunate to have resolved my case so quickly, as I was expecting a 1-2 year battle:

    I, too, had a dispute with the criminals at La Jolla Resort in Mazatlan. They forged a document waiving my right to the "cooling off period", so when (less than 24 hours after purchasing and after seeing countless posts of their unscrupulous practices on the Internet) we tried to cancel our contract, they said we could not. Our option was to accept 50% of our money($7200) back and try to get the rest through the PROFECO. We declined that offer, feeling that we could stop payment through the dispute process with our credit card company, Barclay.

    Long story short, we got NO SATISFACTION from Barclay and we were given conflicting advice from Barclay's reps regarding the best way to go about a resolution. A letter with pages of documentation was fruitless. Here is what we did, and our case was resolved in LESS THAN 10 DAYS:

    1. Wrote a letter to the President of Barclay with pages of documentation including letters, copies of emails and other documents pertinent to the case.
    2. I cc'd the Phoenix -based management company that La Jolla claims they use.
    3. I cc'd the Better Business Bureau and filed a claim again the management company here in Phoenix.
    4. I cc'd the local Phoenix Newspaper
    5. I cc'd and emailed our local NewsChannel 3 consumer advocate who regularly helps people with disputes in a segment called "3 On Your Side".

    Number 5 was the winner. TEN minutes after emailing the Channel 3 Consumer Advocate, named Gary, he called me and the wheels started turning. I provided him with all of the documentation I had. I gave him a detailed account of the case from the day we met with La Jolla, to the day I emiled him. He sent a camera crew to my house to interview me and he started making calls to the appropriate people at the credit card co.

    The story was scheduled to air on the news yesterday, even though we did not yet have a resolution to the case. At 1pm, a representative of Barclay's called and said that my card was being credited $7200 and the case was closed. They would deal with the merchant and they felt that the case would be dead because La Jolla will not go through the necessary paperwork to fight it. They will just move on to the next tourist victim.

    Gary's camerman got more footage of me saying how thrilled I was that this was resolved and the whole thing aired on the 5:30pm news. Case closed. If my case and the new story can save one person from going through this, it was worth it. I was expecting a 1-2 year fight and it ended up taking only 10 days after I contacted the TV station.

    If you are caught in this same struggle, it is worth a try.

      If more people went after such scam artists relentlessly, the scams would stop, or at least be more short lived or resolved.

        We were offered a "hell-of-a-deal" as well, as a last resort with their sales pitch as we were about to talk. They offered to purchase our RCI timeshare for $45,000 because (and I asked the question directly), "they wanted to use it to entice other people to come to Mazatlan". Sounded good to us.
        Then when we are back home and haven't gotten our money and haven't heard anything, I contacted Phoenix Vacation Property Management (who is supposed to be "handling the sale") and upon questioning her, find out that they are only "offering" our property for sale on a timeshare resale site, and haven't "found" a buyer yet. wtf
        Upon bringing this to F Kelly's attention, he keeps telling us "provided by item no. 3 of the NEW OWNERS VERIFICATION/ACKNOWLEDGEMENT, we are in no way liable based on rental and/or resale offers. Just trying to wiesel their way out of it.
        If a company has to resort to fraud to sell their property, that is pretty bad. I hope there is a way to resolve this, but if not I'm willing to go to the media. Everyone has to know and be saved from this.

          Scammed at Boutique Resort LaJolla, Mazatlon, Mexico

          Well , I read some of all the posts here and They are STILL SCAMMING a lot of us now also. I was there in Sept 2010. Yes, they LIED to me big time. It sounded like a great deal . A win win for me. BUT I had to put half down on the LaJolla Resort. And the sales guy [ TREVER FOSTER ] said THAT they would buy my Mayan Time Share and put it into their inventory.[ Which of course was another lie.]And that I would not have to pay the half balance i owed untill I got my money from them. He just kept saying " oh don't worry about that we will ----------bla bla bla. And they [LaJolla] would pay me $2000 per year for 5 yrs to rent my LoJolla out to others. Well, it is now the last week in April 2011. And there has been NO money to me form them and I now know there never will be. I wish I could warn every one going to Mazatlon that NOT TO BELIEVE ANYONE about them purchasing your old time share. I talked to a lawyer today but he said I would have to have a lawyer in Phoenix to represent me since the Management Firm is there [ and I am from Minn]. [ Well, at least the address I have is just a lawyers office for this Firm] I am going to lose my $6000. that I put down. I do not have any resorses to battle this issue. But at least I still have my Mayan time share which has been good. What little I can do is post on every travel site I can in the hopes I can wise up just one person NOT to spend any money At LaJolla in Mazatlon, Mexico. and I believe there are a lot of bad scam sales all over Mexico. I hope others do fall for this deal, like I did. Mag

            The best and cheapest way to get your some or all of your money back is to contact PROFECO (Mexican consumer protection org.). Even if they get nothing for you, at least it will not cost you anything like it would with other sleazbag get your money back scams.

              La Jolla worked us over as well. Trevor Forster, claims he is an ex-airline pilot. He was flying high with his promises. We are out money. We fell for his fast talk and his sell of VIP Travel net. What a scam. DO NOT FALL for his promises. Told us we could get our money back if it was not all and more than he promised. Well it certainly fell short and they have our $5000. OUCH. Any ideas how to get it back would be appreciated. Has anyone had any luck.

                  Hi there, Alina is the supposed manager there that says she is looking after our case where he scammed us as well with his fast talk. In fact I met him here in Vancouver. However, Alina will not return my mail saying that she is looking into this and that Trevor is not the owner as he states he is...however "linkin" shows him as being an "owner" as well as his business card. I think we are going to report this to our credit card as fraud. As well, VTN is supposodly based out of Waterloo, Ontario.

                    Read my previous post on how we settled this with La Jolla. The bank that held my credit card was of no help. I wrote letters to everyone but finally got results/help from the local TV Station. It was resolved in lesss than 10 days!

                      My wife and I meet Trevor 2 months ago, we thought vip travelnet sounded to good to be true, so while we were with him, we asked him to book us a couple of nights over in cabo, we were surprised that he did, and he acutely flew us over their in his own plane, he said he was headed over there anyway, but we did only end up paying 28.00 dollars a night to stay at sunset beach, it was a beautiful 5 star resort, we did just get our membership and password last month, we have gone on line, and the prices he shared with us are the ones we have now taken advantage of twice now for ourselves and family.

                          Can I ask if you are doing anything special to get onto VIP travelnet? I am using my regular username and password and the deals offered are NO BETTER than what you would find on Cheaptickets/Kayak/Expedia/etc... I have contacted La Jolla and rather than helping their customer they say that they don't know what Trevor could have showed me or what VIP travel-net is all about. This makes me feel like VIP TN is just another little pawn in their scam. If it is working for you I would love to actually take advantage since that is what I paid for. Do you have any tips? Thanks!

                            Threatening e-mails from La Jolla Boutique Resort.

                            After posting in many forums like this about our experience with La Jolla, Jolla employees began to take notice.
                            They even suggested that if I don’t stop with my posting I would never see my money again. That is funny, since the reason I began posting was due to my money being gone.
                            It has been an ordeal (as you all know) and rather than post it on the forums I began a blog where I could post their threatening e-mails and their bogus “contracts”.
                            They never gave us the money, but I believe the many postings in many forums and different sites, along with the blog I posted on my Facebook page is hurting them.
                            Please keep posting and read the blog, it is amusing how they deal with their "members."

                            The only hope we have is to closed them down so they don’t do this to anyone else.

                              I was looking up Profeco for a person who sent me a private message and found these new links. One has a blog where people can post their complaint to Profeco on their website and they answer here or send the message to the right department.

                              It may be helpful for some of the people who were defrauded when they bought a timeshare in Mexico.

                                Iconnections,

                                PROFECO is a good choice when the timeshare holder is within his/her 5 day grace period. La Jolla is well experienced when it comes to timeshare fraud and have figured out how to ovoid be punished by PROFECO.

                                If you are planning to file a complaint with PROFECO; Is very important you hired an attorney who will give the proper attention and follow up to your case. If you have questions Just contact me.
