    VIVA vacation points- rescind Help

    Hi,

    I am totally new to this forum and realized and feel I have been dupped. Just purchased into Viva vacation points. Want to rescind but the contract is guided by the Laws of Panama. Any suggestions and support would be great.

      One way to stop the automatic payments is to close your checking account and open another one. You can do this with the same bank. Just tell them that you think your account has been compromised.

        I purchased Grandview of Las Vegas last November, 2010. At the time they said I could transfer my weeks to points. They didn't say future weeks, just weeks. I have 4 weeks booked in RCI and when I went to transfer them they said they couldn't because they were past. Also, the salesman didn't tell me I had to transfer future weeks 90 prior to the date or I would start to lose points. I lost half the points. I have contacted the salesman and the mortage people in Las Vegas and they claim their is nothing they can do. I explained they ommitted important information. I might or might not have purchased if I knew my old weeks were nontransferable. Also not being told I should transfer my weeks or lose points. They say this is an RCI problem, but of course RCI says it is not. Any suggestions of what my next steps should be as I have hit a wall with the people in Vegas? Can't get anyone's phone number higher than those I already spoke with. Thanks in advance for any advice.

          I know this is probably a long time after you have (hopefully) resolved this problem, but I hope I can ask your help. My husband and I live in Australia and have also recently signed up for this same timeshare at the Grand View (I wonder if we could argue against the legitimacy of our signatures if we were under the influence of alcohol at the time of signing - not that we were of course.. ). Of course we were still on holiday when the 5 day cooling-off period ended and so had no chance to cancel in time. Did you have any luck with just cancelling your credit card payments? Were you able to get any of your deposit back? We, too, are wondering if we will be hounded for our payments and how on earth we can get out of this mess.

          I hope you can help..

            Is there anywhere I can turn? Is a consumer group a reputable option? Or am I stuck in this nightmare which may very well ruin my life?

                Selling any timeshare now is extremely tough. If you want out your best bet is to offer it to anyone willing to pay the cost of closing. If you owe anything on it it will be virtually impossible to even give away. In that case go to the developer / loan company and ask to deed it back. IF they accept you can get out that way if not you'd have to consider letting it go unpaid & thus risk your credit with possible foreclosure or pay it off and then give it away for the future fees.                   Want out

                  It's been 11 days but is there any way we can still get out of our timeshare? They told us nothing about the time limit, it never was brought up at all. The lady said she was going over eberything and I should have known what a liar she was. I am just sick and scared and I want out.

                    Rescinding

                    I can't check this forum often, so I would appreciate just emailing me or whatever you can.

                    Purchased TimeShare at Grandview a couple years ago and wondering if there is anyway of getting out of this? There were many instances of being told something at the presentation that wasn't true and I just cannot afford this. I have spent in 2 years of mortgage payments of what I could have spent on several cheap vacations. I have not gotten to use it yet. One of the main reasons of buying this was to help rebuild my credit with the 'mortgage' payments, I even have paperwork stating it will help rebuild my credit...yet it has never shown up on my credit report and when I called, she said something about it being a private type of loan.

                    Anything I can do now a couple years later????? I have tried to sell it.

                      not sure where to start or who to trust

                      Purchased a timeshare at Grandview in Las Vegas as well. On 11/06/2011. Full of regret now. What can I do to make it go away. I don't care if I have to just give it up and make the mortgage disapear

                        You are going to have little success in rescinding a timeshare after the rescission period had expired. You aren't going to have any success in selling a timeshare that has an outstanding mortgage or is behind in maintenance fees, since they are being sold for pennies on the dollar if free and clear. [You might be able to include it in a bankruptcy proceeding, should you be to that point with your finances.]

                        Whatever you do, don't pay a huge up-front fee to have someone else supposedly sell it for you -- regardless of what they tell/guarantee you, or the price they say they have a seller at. Or you'll be out the fee and in the same situation you are in right now. There are a lot of scams right now taking advantage of distressed owners.

                        Sorry, but the best hope you have is to learn to use the property....

                          I went to Las Vegas recently and bought a timeshare from grandview, after research I found it was a scam. It is past the 5day cancellation. What can I do an Can I still rescind this timeshare? I have put a stop payment on my account. So what should I do next?

                            Its only been 16 days since I got the timeshare...I don't want it. Is bankruptcy the only way of getting rid of this timeshare?

                              I went to Las Vegas last month and bought timeshare through Grandview. I was travelling for few days after this contract and I did not find time to rescind in five days. After one week I realised I did a mistake by purchasing this timeshare.

                              I have sent them revocation form with all the materials I got from Las Vegas to their Florida office. But today I got a call and email saiying that they can not cancel this contract because I requested after five days. However they received my mail in 8 days but I was told that it should been within five days after signing the contract.

                              Now I see myself in big trouble...Can someone help me how to get rid of this contract now.

                                I think you are stuck with it. I know that is not what you want to hear but there is not much you can do if you didn't rescind within the 5 day period.

                                You aren't the first person to buy from a developer. I would suggest you try to make good use of it. The resale value is less than 10% of the developer price if that high and timeshares are very difficult to sell. Many people can't give them away for free let alone sell them.
