    I am not sure if the post mark being with in 5 busness days may get you out of it. The extra days in the post office my get you out of it

      Nevada has 5 business days to rescind, it does not have to reach the resort office by then. It only has to be postmarked within the 5 days. Email me at notimeshare@gmail.com

        unfortunately, i do not believe that i have to bury the head in the sand and just 'buck up' and learn how to use the timeshare. these timeshares are a huge big scam and i am not about to just roll over and let them win. i was swindled, and i will do everything i can to get out of it. i don't care about selling. sell what? air? its difficult to sell because people know it is a crock of BS. a very elaborate scheme tied up in 'its in your contract'. unfortunately, i am taking up the legal route because i did everything i was supposed to do in so far as a contract is concerned, and they committed fraud and false representation. i don't take kindly to being had.

          I have paid only $300 at the time of contract signed at Las Vegas. Now I asked my Bank to stop all the further payments. However they received my cancellation form in 5 days but they are denying to cancel it now. As I stopped all the payments from banl now. Can someone suggest me what are legal actions they can take now.

          Or what are the other consequences can happen if I dont pay any ammount to them ?

            You don't sound sure of when they received your paperwork or even when you sent it. Go back and check the exact dates of when you signed the contract and when your mail receipt says you sent you paperwork (you did send it certified mail, right?). When you have those dates, come back here and someone will tell you if you can or cannot rescind.

              I agree with hedykay on this.

              Everyone seems to know some part of this is a "scam", i think everyone going on a list (with regards GrandView) then writting to a judge is in order here. They seem very happy to screw over peoples lives and claim you signed for it, however the reason you signed wasnt the correct one as thre sales guys made it look nice.

              I have a Grandview (fully paid) for sale here (its free if anyone wants it), however i was told i could "stop using it like i never signed" and yet as thats not in writting there seems to be an issue, well i signed, so i can "unsign" as well......

                We came across this thread after deciding to cancel our Berkely Time share today, well within the 10 day window. There was no revocation letter in our packet. There was, however, a terms and conditions section in the "contract for purchase and sales" which states "If you decide to cancel this purchase contract, you must notify the seller in writing of your intent to cancel" It later goes on to state that we have 10 days to do so, to whom it should be addressed and that the notification should be sent via certified mail with return receipt. As we had not "official" revocation letter we sent the following in business letter format, signed though not notarized via certified mail.

                Need the letter be notarized?

                Will this letter, text wise, suffice?

                Should we send another letter in the suggested format that member VioletFlux posted at the start (Sample Revocation Letter, posted at 03/15/09 2:18PM) of this thread? After reading through the entire 7 pages of this thread, it doesn't seem necessary to follow all the steps mentioned in those 1st posts and that the certified letter and return of promo material will suffice, is that true?

                Finally, as we are still in Ft. Lauderdale, would it perhaps be simplest and safest to deliver the revocation notice (in which format) and promo materials in person?

                  STEPS TAKEN TO COMPLE REVOCATION FORM

                  1ST
                  DEAUTHORIZE PAYMENT!
                  Called my bank (attached to the card they imprinted)and placed a stop payment on the amount and company authorized in the contract for the downpayment. This will save you a huge hassle over negotiating your refund. DO THIS RIGHT AWAY!

                  2ND
                  SEND OUT THE PAPERS!
                  Within 24 hours of the signing of the original contract I went to the notary and had two copies of the Revocation Form signed, notarized and sent out (By the same person) FedEX Priority Overnight Certified/Receipt requested mail. These were sent to the El Dorado Resort Address as outlined in my contract and the Grandview Resorts where the contract was signed (To leave more of a paper trail) I went onto the Fedex site and had them email me copies of the signatures upon arrival as well as receipt of delivery. I kept and copied all the receipt information. I than emailed a copy of the revocation form signed, a letter requesting a revocation and the FedEx tracking numbers to all the emails listed above. Than I called and left messages on every voicemail I could letting them know about the revocation, the tracking number, and the fact I would be calling about the delivery the very next day. I kept detailed track of who/when and what number I called, who if anybody I spoke with and what was said. (I"M A JOURNALIST, IT'S WHAT I DO )

                  3RD
                  FOLLOW UP!
                  I called the next morning to verify the delivery with the main parties involved, mainly the cancellation department (Las Vegas) and the mortgage department(Florida). Because I had done my research in advance I was able to press my representative in Florida to tell me that I must return the materials I received from the Grandview salesmen or I was going to be charged. She told me It would take 20 days to process, but I insisted it be done now. She was surprised to hear that the Las Vegas location already had a certified notarized copy of the revocation in hand - so no delaying tactics about faxing over a copy in 3-5 days. I also followed up the the Las Vegas location making sure my revocation form was received, my contract canceled, my payments deauthorized and to garner a confirmation code on that.

                  4TH
                  SEND THE MATERIALS BACK!
                  My representative from the mortgage department specified where I should sent them - in this case El Dorado Resorts location in Florida - so I did. Than I emailed the tracking information as well as calling and leaving the information on various voicemail recordings. I included a COPY of a signed letter saying I was returning the materials per her request to satisfy the condidtion of Revocation. I also included a COPY of the email I originally sent detailing the original revocation/tracking number, ect. And because it's me I also went the extra mile and took a camera video of me packing up the materials, putting in the letters and such and shipping it through FedEx 2nd day express. (JOURNALIST, REMEMBER )

                  5TH
                  WRITE A STATEMENT
                  My husband and I took down statements about our experience, noting all the inaccuracies presented to us that did not hold up on further research. Some of this was in writing, though most of it was verbal, so we wanted to make sure to get down the info right away before the details became blurry.

                  6TH
                  PAPER TRAIL PAPER TRAIL!
                  I sent a copy of my revocation, my contract and all the steps, information, people I spoke with copies of receipts - generally anything to do with this issue to the fraud department at my credit card company. This covers me and helps them to investigate this fraud further. It also helps in case your stop payment was filed to late - They can "Claw" back your funds and negotiate directly with the mortgage department. They will also cover any fees associated with your claim until the manner is resolved.

                  7TH
                  CANCEL TRAVEL/EXCHANGE CLUB MEMBERSHIP
                  Verify with RCI or other Timeshare Exchange Company that you have not been set up with an account. It may be too soon for them to have the information processed, so you may need to call 6-8 weeks latter to ensure that no account has been set up using your information and name.

                  FINALLY,

                  1. Realize that its worth the hassle and short term expense to save yourself a lot of expense and hassle in the long run. I stopped agonizing over every cost, despite my penny pinching ways. ITS WORTH IT, I can't stress it enough. Send it express, get it notarized, cover yourself at every opportunity. The more recorded paper trail the better for you, should you ever have to take it to a legal entity.

                  2. Don't beat yourself up about making a mistake. Your not the first, nor the last to be pushed or talked into a bad decision. There are many sites like this one that can help you dispel some of the anger or frustration of dealing with this. Take a deep breath and chalk it up to life experience. You're not going to be jumping into any other spur of the moment buys after this!

                  3. Don't throw the baby out with the bathwater. Timeshares are not generally a bad thing altogether, however being pushed or bullied into signing a contract without doing the research is. After this is all over take the time to evaluate timeshares and your lifestyle, if its good fit - buy resale. Realize that very few timeshares ever make a profit.. You do this because it fits your lifestyle and because it may offer opportunities you would not have access to otherwise. Be smart, take the time to do the research so you'll make a good decision.

                  We also got suckered for this scam while holidaying in Las Vegas. After 5 hours we finally succumbed to signing. I must have asked them about 5 times that we definitely had 5 days to change our mind. On the way back to the hotel I had this funny feeling we had made a mistake. After searching the Internet for 30 minutes we were convinced we needed to get out and fast. Thankfully we found this thread which pretty much gave us a plan. We have made several copies of the revocation letter and have written letters to Eldorado Group, Grandview and the verifications officer. We will be sending them certified mail, receipt requested tomorrow as it is Sunday (day4 calendar day although really day 2 if it is business days). We will be following up with phone calls etc to make sure this gets resolved.

                  We are wondering if we should send the RCI materials (the box of stuff) to Eldorado or Grandview? We travel to San Francisco for another weeks holiday so would like to get rid of everything before we return to Australia. Also what about the copies of the contract etc do we hold onto them or will they too need to be sent somewhere?

                  We only paid $400 on the day and they are meant to be taking out another $894.00 on the 13th December. Should we contact our bank and make sure the next payment doesn't come out and then we just have to work on hopefully getting our $400.00 back.?

                  This has certainly been a huge lesson and one that should resolve itself. At least we enjoyed the dinner and show tonight and we are not going to let this spoil our holiday. Shame on those who take advantage of others there must be some sort of bad karma coming their way.

                    I just wanted to thank you from the bottom of my heart for posting this. We were pressured into signing up for a Time Share last Tuesday while on vacation in Palm Beach. By Thursday evening I was deeply regretting it and basically by 3:00 Friday morning - having not slept a wink - I started searching online for anything that might help with the problem.

                    By 6:30 I'd typed up my letter (and finally got 2 hours sleep); as we are still on vacation we went to find the local library to print off the letter. We left one with the pack of info on the desk of the Time Share Office in the hotel, so it was waiting for them when they came in. We were about to go to the FedEx offices to send off the other copies when we got a call from the Time Share office. She was so understanding when we explained why we had signed up. She told us she would cancel and gave us a signed document as proof - and we'll get a full refund of our deposit within 21 days.
                    I'm absolutely sure that the professionalism of my letter - because of the info I took from yours - helped enormously. THANK YOU!!!!!

                          Please be sure to comply with the requirements of the contract in order to protect your rights. "To the purchaser: you may cancel your contract without penalty or obligation within 10 calendar days. If you decide to cancel your contract, you must notify the seller in writing of your intent to cancel. It shall be effective upon the DATE SENT and shall be SENT TO the seller at their cancellation department address in FORT LAUDERDALE, FLORIDA by certified mail return receipt requested." Until you have done this, I fear that you risk being told that you did not comply and you might lose your right to force them to provide your refund according to the statute. Details matter.

                              I would like to update this thread with a recent experience with this timeshare company and how I went about rescinding my timeshare. We vacationed at Vacation Village, Weston, FL in late July 2015. We attended the sales meeting, which was over 3 hours in length. Just before we were about to leave we were given one more sweetener and unfortunately agreed to buy a week during odd years. After researching the points system a little more I determined that we made a bad deal and wanted to cancel. Thanks to this forum I had the information I needed to get started. Florida statutes requires the seller to inform the buyer that we have 10 days to cancel the contract. The 10 days starts when the contract is completed and the cancellation is as of the date of the postmark when sent to the seller. It is important to follow the instruction in the contract to protect your rights under the statute.
                              I mailed my letter demanding cancellation and refund 6 days after the contract date. I sent them copies of the documents so they could not delay the process by asking for the documents. I retained the original documents I received at the closing. I did not send the books or promotional materials, only signed documents. I sent the package to the cancellation department at the address given on the contract by USPS priority certified. This certified letter allows you to track the package and serves as proof of delivery. Requesting a signed return receipt might cause delays if the PO will not deliver and a signature is not obtained.

                              Then I waited anxiously. I did not call them, did not write them again, did not hound them, did not follow-up other than verify that the tracking number showed delivered by the USPS. I felt it was important that I did not cause a default on my end, so I did not cancel payments or dispute cc charges, knowing I could do that later if necessary.

                              From the date of delivery they have 20 days to refund all charges. After 10 days I called 954-563-2444 to see if they received the package. I talked to a nice lady who informed me that they had the package and were processing it.

                              Two days later I saw the refund on my cc. The next day I received a letter from Vacation Village confirming that the timeshare was cancelled and a full refund was made.

                              In the letter were several options for them to use. I received a full refund. Possible reasons for not receiving a full refund included: a default by the purchaser such as nsf or cancelled payments, not returning all documents, incomplete contract. I feel it is important not to give them any excuse to hold up your refund.

                              Overall, this experience was trying, but the cancellation went fairly smoothly once I got all the work done. The key is to cancel early and follow the instructions in the contract. If you wait more than 10 days, or send it to the wrong address, or don't send all of the documents back, or default on the contract, you may be out of luck.

                              Thanks for your help on this, what a relief. I still enjoy timeshare ownership, but not this one. I hope this will help someone who needs it.

                                I own in another V V resort and it's still a good ownership if you buy it resale.
                                I own in Vegas and Orlando and have for around 10 years in the RCI points side.

                                And I actually visit this Weston property often. Love their pool and
                                the units are decent with a great room mate arrangement.

                                If you stay out of the "update" it's more enjoyable although I find it one of the
                                most generous payments for sitting thru an update so if you have nothing else
                                to do this makes for a pretty profitable 3 hours and 3 hours it will be!
                                Guido and Tony will make sure of it!
