  • I need advice quickly-please help!

    Hi,
    Someone on the trip advisor board directed me to this site. I need some advice quickly please!

    I was in Mazatlan Mexico with my wife last week. We signed up for a timeshare at Torrenza, with the following promises:
    1. My existing Bi-Annual Time share would be purchased through Sierra Club within 150 days. Price promised to pay was our original purchase price 2 years ago.
    2. We would get 2 grand a year for not using our torrenza time share for the next 5 years. ( We signed up for 2 weeks a year)

    Now that I have gotten home, been contacted from Sierra, I don't feel confident at all.
    First off, I have one contract (the 3 page contract listing terms etc) that checks off "RED" time. But on the 1 piece of paper with fiancial info on it it says "WHite" Time. I did not catch this until now. I called Torrenza and they said it does not matter since we are depositing the weeks, but I am very uncomfortable with that response. I cannot vacation in June or September-the white months!

    I was supposed to get my first 2000 in 90 days accorind to Trevor the sales manager. Now Sierra is saying I will not get it until next year. I am also learning that it is a trick to promise to sell my other timeshare, and I have no faith that they will be able to sell it for the price promised.

    What options do I have? My 5 days window is up, but I feel like I have been lied to and tricked? Can I have my credit card reverse the down payment?
    Do I have a leg to stand on?
    I feel so sick to my stomach right now. Thank you to anyone who can give advice!

    I will say that you are one of the few that have popped onto our site and asked for advice vice advise. Anyway, you are too late, sorry. You have been duped.

    They probably won't ever sell your timeshare, if that's what they promised. Sierra Club or whoever is probably not coming to you rescue. If they promised to take your timeshare in trade for a certain price off your new purchase then that may or may not happen. You certainly would have received the discount but they may never transfer title, leaving you with MFs.

    They will not be able to rent it for you and you will not pass go or get $200(0).

    At this late stage, all you can do is file a complaint with PROFECO, search this site and google that name also and file youor claim of fraudulence. Unfortunately it sounds like you have nothing in writing. Good luck and let us know how you come out. Don't be a stranger.

      If you didactually get a discount on the sales price, wait to see if they sell your old one (probably not). Then try to sell it on eBay with a $1.00 price to try to unload it so you don't continue to be held liable for the MFs.

        I just wanted all to know that Chrome was referred to this forum by me......after much conversation on Trip Advisor.

        I know, it is late for him/her but he is looking for any and all advise on what to do...

        I gave some input to him......and hoped maybe others would have some as well..

        I had dealings in the past with Sierra rentals...duped and also with another company saying they would take one of my timeshares off my hands etc...guess what I still own it...

        Unfortunately Chrome is in a dither so to say and really is distraught. Also unfortunate that he has found this forum and a few others I referred him to...maybe too late, but maybe not.....

        I think a rescind to Profeco, even though past the 5 day period cannot hurt..at least it is a try!

        I hope Chrome will get info he needs and then maybe even join us on this site, for future info and become a part of our great forum. ( hope it is okay to say "our" great forum......I know it is not mine, but I am certainly a part of it....think that is okay to say??)

        I feel so bad for so many who do not find forums such as this before their troubles!!!

I have zero experience to rescinding problems, but I say to TAI- here's an opportunity to show us what you got. Please see entire posting before you proceed though. many experts has challenged them on their expertise on rescinding help.

            Can someone help tell me how to send a rescind on this? I know it is past the 5 days, but I am disputing this with my credit card company. I don't want to send all my original documents to Torrenza. What exactly do I need to send to Torrenza, and Profeco?

              You need read your contract, and follow their instructions

              On how to rescind your contract. You also need to send copies to Profeco
              As to what exactly you need to do, you have to read your paperwork, no one else can do that for you as you are the one with the contract.
              Profeco is a great agency, they are methodical, and will seem to be taking for ever, but they are you best hope of unwinding this package.

                Somewhere on here or on TUG is a very detailed list of how to rescind....If I find it I'll let you know Chrome...in the meantime do as above poster advised....best wishes!

                  I contacted Timeshare Advocacy and Sean called me back very quickly and is helping me draft a response. So far A+++ as far as they are concerned!! I also have called my credit card company and disputed the charges.
                  I don't know what will happen yet, but I will let you guys know. I wanted to thank everyone for their advice!! I feel like I have a fighting chance at least. Wish me luck, and I will keep everyone informed of this mis-adventure.
                  Hopefully it will turn out ok, and I can help spread the word to others before it is too late.

                      If you haven't contacted Profecto, as aliikai2 Aloha, Moderator posted, you are making a huge mistake. The Mexican government is concerned about its tourists being taken in by false promises; they do not want their tourist relations further damaged. Because the timeshare industry fears Profecto, they respond to Profecto. Not dealing with them is, in my opinion, a mistake.
