  • Grandview revocation ??????

    I purchased the Grandview in Las Vegas on Sept 29 and sent out certified mail on Sept 30 from my hotel to recind it. I sent the mail out express and certified only to find out that U.S.P.S., does not ship certified mail express. When I got home (CANADA) I found that it had been 5 days and my letter had not yet reached Florida. I phoned hotel to find out that the letter came back to the hotel and they resent it out on the 6th of Oct. The guy @ Eldorado resorts is saying that I missed my 5 day period but, I do have proof that I sent it on the 30th of Sept. Does he have a case?

    If USPS doesn't do it, then how did you do it?

    Anyway, certified is not required but that's how you have proof. If you kept the receipt of payment for the postage that will probably work also, but it sounds like you didn't make the post office transaction (?). The requirement is that you post it prior to the end of the cooling off period, whatever it is for Nevada.

    Your problem is that THEY hold all the proof in the form of the cancelled envelope. Get an affidavit from the hotel, if they did all the transactions and get a lawyer to send it to them. They probably won't budge without that threat, They are quite cutthroat.

      Thanks for the info. I do have the hotel legal dept. working on this. Do you know what type of lawyer is required and do you know one in particular, just in case I still need one?

        My opinion is that you just need letterhead that has Esq. on it.

          Need help

          We purchsed Grandview Las Vegas on Wednesday afternoon, 10/14/09,
          and arrived back home in Georgia this evening. Unless I find a way to
          register/certify my revocation tomorrow, Sunday, I will need to wait
          until the post office opens Monday 10/18.....am I correct in thinking
          I will be within 5 days?????. I can be reached at itsmeboat@live.com,

            Sounds like less than five days to me if that's the NV law. It's the postmark that counts, not the receipt, and as you can see this company likes to play games.

              You are right. I spoke with my attorney and he tells me that as long as
              I mail on Monday, 10/19/2009, I am within the law. I also sent a revocation
              form via e-mail , signed electronically,.. to Grandview at Las Vegas, Nevada
              Real Estate Department, Visa ( cancel down payment) The Berkley Group, our
              attorney. The revocation form was also faxed to The Grandview and
              El Dorato Resorts. I also told The Grandview via e-mail that their catalog
              brochures were left for them at the front desk at the Flamingo, noted as
              their property for pickup, with my name. Can anyone think of anything
              else I should do before midnight tomorrow.

                Not a smart move, I don't think they're obliged to pick-up, they'll charge you for materials.
