  • Transfering timeshare in HNL

    Hi, Im new to the timeshare world. I will be receiving the timeshare that is in my soon to be ex-husbands name. I need to transfer it to my name. It is in Honolulu and I read something on another thread about a recent change in transfering. Could some one step by step me through how/what to do to put it in my name? I am also wanting to do it the least expensive way of course.

    I'm personally not a fan of do-it-yourself closings unless you are very experienced with timeshare deeds specific to the resort being transferred.. Over the years I've seen far too many sellers be forced to default due to to their inability to convey ownership cleanly because of deed errors or because of an uncooperative ex still showing on the title! It's worth a little cost to ensure everything is done properly.

    Start by contacting your resort directly. Ask for owner services or the department that reviews transfers. Tell them what you will be doing, and ask for specific instructions from them on any resort procedures or transfer fees that will be required in addition to deeding. You should also ask them if they can recommend an attorney or company to prepare the legal documents for you. Call that company and get an estimate for a quit claim deed and recording fees.

    Others may give you some additional suggestions, but I'd recommend you also contact Hawaii Escrow & Title (http://www.hetinc.com/). They appear to be handling the majority of timeshare deed prep on the islands for resale transactions, and have always been reasonably priced for Hawaii. You will tell them that all you require is a quit claim deed conveying ownership from you and your husband to you as sole owner. Compare their quote with the other company and choose the lowest priced option. Once you have an executed and recorded deed, simply follow the other resort specific instructions to complete the transfer and remove your ex. (Please be aware that if there is still a mortgage encumbrance, he will continue to be shown on that note. ).

    Kudos by the way for actually taking the necessary steps to accomplish the transfer. I can't tell you how many sellers have submitted a divorce decree to me, believing that document somehow removed the ex-spouse from the conveyance.

      Deeds in Hawaii are not just a copy and paste. they are very long and detailed, actually fairly consumer friendly in terms of reading them. HET may not be able ot do a deed without title insurance or some kind of title search, at least that has been my experience.

      You might try a site called Justdeeds.com, it is a site owned by one of my companies and I know we do Hawaii transfers using an attorney on the island to prepare the deed.

      Might be an other avenue to look at.
