  • How did you handle timeshares in your Will?

    DH and I are updating our Wills. We own 4 Deeded timeshares jointly, and I own 3 in my own name. He knows about them but doesn't have a clue about managing them and thinks its like calling a travel agent.

    If I pass first, it isn't going to be pretty (unless he logs on to ts4ms and hooks-up with one of the single ladies on this site) Hey, maybe that's what I should instruct?

    My kids have all expressed an interest in owning, and DDs have even gone on Marriott tours, but it would be hard to divide "evenly" as they only want the Marriotts! And I'm not sure I want to saddle them with the maintenance expense.

    Did you include timeshares as "real property" and bequeath to individuals or just let the chips fall where they may.

    None of my timeshares have any value, so when we set up our Trust, we did not include them.

        Can you legally deed them back to the resort or to the developer?

          I never thought of it, but I am sure my kids would NOT want my timeshares when we are gone. In fact, I don't think my husband will want the bother of them when I am gone.

            Both of my dds have said they do want our timeshares. Right now they are in the trust. When the time comes, since I won't be around, I guess they can figure out what they want to do with them.

              Our attorney told us not to put our timeshares in our trust. One of our "kids" said that he did not understand why we even wanted timeshares. The other one does like one of ours, but commented that his brother would want to sell them once we died. I told him that they were only worth about a dollar and then he would have to hope that someone would pay the transfer fees, so he would be able to have the one he wanted for free since there were no costs for heirs other than paying the annual MF. We have made a point not to have their names on our timeshares so that if they did not want them, they could just send a copy of the death certificate and a note that there was no more money.

                I believe so, but they do not have to accept them. It might be interesting to try tho.
