    I'm selling my timeshare- what taxes am I going to have to pay at closing?

    This is one of the most common questions I'm asked by Sellers, and is one of the most difficult to answer... My first recommendation is always the same- always speak with your accountant or tax attorney!

    Both state and federal taxes can affect you during your transaction. As a rule of thumb, a Seller can generally expect to have some type of non-residency tax withheld from your proceeds at closing if the deeded property you are selling is located in a state or country with an annual income tax (and you don't reside in that state or country).. Examples of these are FIRPTA (USA), HARPTA (Hawaii), CALRPTA (California), MNITR (Maryland), and there are many others.. For the most part, these range from 3% to 10%. For a non-US seller, it is also common for you to be subject to both state and federal withholding. In some states, if this withholding is not submitted- the government has the right to pursue the new owner for the unpaid tax.

    As a Seller, always consider that if your transaction results in a gain it will be taxable, but that your losses are generally not deductible.

    Add South Carolina if you sell for more than you paid for and New Jersey based on the sales price for non residents. I want to say South Carolina if you sell for more than you bought it for, does not happen ofter, but if you buy on ebay for $1 and sell for $1000 you get the tax is something like 7% of the profit.

    New Jersey on the other hand is something like 9%

      If you make less than $250,000/year, you don't have to pay any taxes . . . or did I get that wrong?

        That would be if you are selling your primary residence, so unless you live it in 52 weeks a year for 2 out of the last 5 years, the IRS would like you to pay your taxes on the profits of your sale. Also it is $500,000 if you should happen to be married....

        Most of what was talked about above is the taxes each state will require the closing company to withhold and send to them as part of the recording of the deed for non residents selling property in their state. That does not even talk about the taxes you may or may not owe to the IRS...

                  People read people on the Internet based on how they tend to talk. I tend to take a shot at humor, which, admittedly doesn't come off well, sometimes, due to the interpretation/disposition/predisposition of the reader.

                  I read your post the way I did (unpleasant and sniping) because that's how you've been the last few months. I've let ride, but you've kept it up.
