Question about purchasing week 33 at Fox Run?

  • Question about purchasing week 33 at Fox Run?

    I am looking at a week 33 at Fox Run. Unit is a fixed week the owner has not yet used his week 33. If I go ahead with this now, week 33 is about 1 month away.

    Here is my question.

    Since the owner has not deposited his week with II what would happen if I do not close by week 33? Do I loose this week? What other arrangements can I make with the owner. According the the Realtor, this owner does not trade this unit in RCI or II.

    I would of course like to take that week and deposit for a trade.

    Please let me know your best advice.

    At this point, I would insist that your ownership start in 2008 - and that you won't be paying 2007 maintenance fees.

    Even if you could deposit the week today - it would only be good for a flex change exchange with II.
    And you can't deposit it because you don't own it.
    Lake Lure Realty (Formerly Redden Realty) used to do the closing with deed recorded in 4 weeks and then there was the VRI notification and transfer fee - about another week - it is not going to happen in time for you to deposit.

    Enjoy the ownership of your week - I was an owner of 3 weeks there for 5+ years and always enjoyed great trades.

      Bill I don't think you will have any options. If you close in time II may not take the week because it is under 2 weeks from check in date. You could ask the owner to deposit then transfer the week into your account once you own it but the trading power will stink. If the week gets into II or RCI with in the last 3 weeks it will trade as bad as a bad blue trader. No one will take it if it gets deposited in the last 2 weeks.
      Now another option is, You could call the resort to see if they can rent it out for this year for you.

            I purchased a Foxrun week 33 on E-bay on March 18th. I am still waiting for this to close. I had thought that I would have no problem getting this closed in time to deposit the week with Interval, but sadly that didn't happen.

            If you have a choice, I would use Lake Lure Realty or another NC company to close the week for you.

                I also recommend Clark at Lake Lure Realty to do the closing - my last one that I sold this year had a 4 week turnaround.....to the poster who said they ave been waiting 4 months - this doesn't seem right...check daily with the closing company - and i would decline to ay the 2007 MFs as well.

                  By the way I am indeed dealing with Clark. He is a great guy. He gave me the option of going with a rush on this unit for week 33. He indicated that with a rush priority I could possibly get the deed in 10 business days. But I declined that offer since I already have plans for the remainder of this year, in addition to the fact the Grayfal, and Frank think it will be a loss for 2007. So I insisted that I start this usage in the contract for 2008. I should be getting the contract soon!

                      Unfortunately, many of the eBay sellers are as slow as molasses when it comes to closings. I bid on a SoCal floating beach week (floats weeks 8-48) in early February. Despite repeatedly contacting the seller & the closing company, it didn't close until about a week ago, 5 months after I bought it. I also kept asking the seller to make a reservation for me -- late summer or early fall -- and they didn't. I ended up with week 47 (which is the week after Thanksgiving this year.) Gee, week 47 on the beach -- that's a good use of my MFs.

                      NJmom, you could try complaining, but I'm not sure it would do much good. You might want to try renting the week rather than depositing it.

                      Clark is a stand-up guy! I have had several transactions with him, and most were very quick. Also, Lake Lure Realty has very reasonable commissions for selling timeshares, and their closings are very reasonable, too, when you consider that NC requires lawyer review of all third-party closings.

                      To the original poster -- starting in 2008 is the way to go! Glad it worked out.

                        I was required to use Timeshare Transfer Inc who get good reviews on TUG for this closing. My personal reviews of them however, have not be good. I sent TTI a cashiers check for purchase price, maintenance fees for 2007 and closing fees in March.

                        It is a long story, but I was assured by TTI, on multiple occasions that everything had been sent out and I just had to wait. When I pressed them at the end of June, telling them that it simply wasn't possible for it to take this long , the finally researched it and found out they had not forwarded the deed to the seller. (They can't send it directly to the county as they are not licensed in NC).

                        It took over 2 weeks after that for the seller to receive the deed(last Mon). They have told me they sent it to Rutherford County, but I spoke to the county and they have not yet received it.

                        The seller has said they will reimburse me for the maintenance fees for 2007 if I cannot use the week. I had hoped to deposit this with II, but as this is my first II timeshare I don't even have an account yet.

                        Hoping for a happy ending.

                          This doesn't make me think this is a scam. Many of the eBay closing companies take forever. In many cases, the seller didn't actually own the unit at the time they sold it, which slows things down.

                          Another problem here may be that in NC, only lawyers of principals (the buyer and seller) are legally allowed to prepare deeds. Maybe they are looking for a lawyer to sign off on the deed.

                          It's good that they refunded the 2007 MFs. My guess is, you'll have to keep after the closing company, but it will close eventually.

                              Timeshare Transfer has been very slow on a purchase we recently made in Hawaii. I am pretty upset because we also paid the fees for 2007 and won't get much time to use the week, but at least it is a float. We will probably rent it for maintenance fees for this year.

                              Bill, it is great that you are waiting for 2008 usage.
