  • Does Bluegreen have a Right of First Refusal clause?

I am in the process of purchasing some points that I found on eBay. I checked with the agent, and he said that CloseMyTimeshare has forwarded the paperwork to BG for ROFR. To date, I was unaware that BG had such a clause...

    Anyone know for sure?

Yes, fairly recently (in the past few months).

I thought ROFR had to be written into the original CC&R's or into the original trust documents. Did they always have it but only started enforcing it recently?

I just got this info from the closing agent (closemytimeshares) ..interesting.

"Yes, Bluegreen does on some occasions to exercise their ROFR, we call the form a recap which basically will not be used any more, for Bluegreen’s new policy is that they want a copy of the contract between seller and buyer."

Yes, recently enforced. But no need to worry that they will exercise that right. No one on the Yahoo owner group has reported losing a sale.

It's a good strategy for both price control as well as limiting the negative impact of postcard companies. Bluegreen has always implemented a limited reacquisition program through Pinnacle, where they've gone onto public classifieds and repurchased targeted inventory at liquidation prices.

The points arrived in my account today. So it was about 45 days after filing with BG.
