    Ok i rescinded on my developers contract just in time so i could buy resale. I received a call from bluegreen today with a message that my cancellation is in process however they wanted "gift" items that we received during our purchase returned back to them. These items are the bluegreen owner manual, a couple other books and a canvas bag to carry these items in. It also stated if we didnt return the items then they would withhold $75 of our money. Is this possible?

    I didn't read anything regarding this and im concerned that this is another lie that their sellers are leaving on my answering machine just to see if we would bite. I would estimate probably $25-$40 in shipping fees to ship these items back due to their mass so if it's a contractual agreement to return these "gifts" then it wouldn't benefit me to return them because they are much needed since ill be buying resale. Could someone help me in this situation?

    Yes, they can, but I have seldomly seen some companies ask for that.

      It won't cost $40 to send a bunch of books. Pack them up and send them media mail (yes, even the tote bag). Get a tracking number and insure them with return receipt requested. It probably will come to about $10 or $12 total.

        Or keep them and consider the $75 money well spent to get out of the deal! Then you'll have all the books for reference.

          My experience buying resale is that you do not get any of the information with the sale. If what they gave you was and is helpful, you might consider keeping and paying the cost, if not return it.

            Most Resorts/Clubs send very little or charge for the information. Vacation Internationale sends a lot of info but charges $150 for the transfer, $100 if you're already a member and don't need the packet. Powhatan Plantation Resort charges $50 to transfer and sends a mostly useless packet of legalese. MROP/ORE sends a nice member kit, can't remember the costs. I once 'bought' a Fairfield Alexandria just so I could take all the materials home and study them, I returned everything the next day including the cute bottle of champagne and two little glasses. $75 for BG is not exhorbitant if you're going to buy BG anyway on resale, you'll have saved plenty.

              I recently cancelled also. Look at the Terms and Conditions of your contract (if you received this). Ours was on the third page (Item 9) under Refund Privileges. We sent the letter and tote bag/books all at the same time via certified mail w/ return receipt requested. All together it cost about $17. I personally don't think the materials are worth $75. You can get the same information from them online.

              We purchased in FL. Documents may be different if purchased in another state.

              I have not received a refund yet. Florida law provides 20 days with some stipulations.

                We bought from the developer, quite happy with our purchase, even though we do know about resale, on Oct. 1. Our first payment was to be due tomorrow. We received a call and then an email stating that the contract is incorrect and they want us to sign a new one which they will overnight.

                The new contract more than doubles the cost of the Blue/Green timeshare. We experienced so many problems at the preview with the paperwork that we should have known that it was a sign of sorts. We ended spending an extra hour or so there while they tried to correct this paper and that paper only to find out almost a month later that the price is completely wrong and now they want double. They said their worksheet was correct but the contract that we went over, signed with the financial guy, the amounts he dictated into a recorder, are incorrect.

                We sent back an email today informing them that this was not acceptable and that we would not be going through with the purchase since the original contract price was not being honored. We informed them that if they wanted the incorrect contract back to please credit us back our money and send an envelope out for their materials and we would send them back upon receiving our money back.

                Anyone else go through this or did everyone here strictly buy resale?

                  only sour thing we experienced was the fact that only "select" members were able to do the bonus time. "select" was being a referred attendee. Although we overpaid, this is what really made me rescind on the deal. I was lied to by the salesman to buy TODAY. I figured i deal with these lying practices on car sales, i am not going to get this pulled on me through a timeshare salesman.

                  IF they are doubling the price, i would tell them to get lost.

                    I'm sorry to hear that they pulled this on you. Our original contract was with BG and everything went very smooth. Hopefully this is an isolated incident or truly a mistake. If you don't mind me asking, how much was the original $/pt verses the revised? I also think it's worth asking for a copy of the tape to verify what they say. It would be interesting to hear what they tell you.

                      Well they have informed me that I can' t cancel and that their compliance agreement basically states that if they make a mistake it is too bad, so sad for me I have to take whatever they say it is suppose to be no matter what.

                      We agreed and it was recorded that we agreed to 84 payments of $101.84 with our down, (including all the junk fees), of $1170.33, for a total purchase price of $9724.89 for 8000 EOY points. I believe it was a resale through their office. Now they want us to choose one of these instead:

                      1. 120 payments @ $135.03
                      or
                      2. 84 payments @ $160.24

                      We can not believe that a company can do this. Any suggestions from anyone? I need to know what kind of professional I should have look over our paperwork because it just doesn' t seem legal to me. They made this deal too good to pass up which is why we did not go with private party resale and now they are trying to change everything, (28 days after we signed and 3 days before our first payment was due.)

                      They have stated that if we do not choose one of the choices of payments and sign new papers with them then we will be in default. I told them we were more than happy to comply with the original contract and agreement or else I want them to cancel the deal and refund my money. Now they are sending out some paperwork, (I have not received it yet), that is suppose to prove that we are required to to choose one of the two options they are now presenting to us.

                      What would you do?

                        Which state were you in when you signed the contract? I am not a lawyer but I believe every state has their own laws pertaining to contracts. It may be worth a consult fee for an attorney.

                        If you purchased in Florida you may be in better shape as they have certain laws to pertaining to timeshare purchases that might protect you.

                        My contract stated that I could cancel within ten calendar days after the date of signature or THE DATE ON WHICH YOU RECEIVE THE LAST OF ALL DOCUMENTS REQUIRED TO BE GIVEN (pursuant to Florida Statutes).

                        Most state statutes can be found online.

                          I could be wrong but according to these figures it looks like their intent is to get about $1.25/point from you. This is actually under the current per point developer price ($1.66/pnt I believe). This is assuming a 12.9% interest rate.

                            Hi Redman!

                            Thank you for replying. I reside in California but we went to the preview in Las Vegas, Nevada. It states:

                            "The purchaser of a timeshare may cancel, by written notice, the contract of sale until midnight of the fifth calendar day after the date of execution of the contract."

                            They sent us an email on the 27th and called on the 28th to let us know that they needed to change our contract right away. Do you think that our 5 days would start once they send over the new contract?

                              I think I would consult an attorney before I signed another contract. Some offer a free consultation.
