  • How to find what Trust Fund Points are in?

    I am trying to find out where in the paperwork one would go to find out what trust fund my points are from. I am aware of how to calculate the maintenance fees but is there somewhere on the Assignment of Owner Beneficiary Rights or any of the paperwork that would tell me my points are from Trust Fund D or E?

    The way I do it is I send an estoppel to Bluegreen and ask for the detailed breakdown of the ownership. Then, I use my knowledge of how all the packages work to deduce what type it is. That's the only reliable way I have figured out how to do it. That's because sellers don't know what they own. They don't even know typically what their real maintenance fees are. And, most Bluegreen employees eyes will glaze over if you ask them the direct question.

      Thanks for the reply. Just to show my ignorance, what is an estoppel? The current owner gave me the breakdown from last year's maintenance payment. He says he purchased directly from Bluegreen in 2005. What type of maintenance fee structure does this look like to you?
      Maint fees: 485.20
      Assess: 33.60
      R.E. Taxes 72.80

        That's an easy one. It's a Trust Fund E deed. 8000 annual points.

          An estoppel is a form that you send to the resort to verify the details of an ownership. It is most often used to determine if the owner is up to date on their payments and if they have a mortgage on the property. You can verify lots of other stuff on the ownership as well. You must get the authorization from the owner for the resort to respond to an estoppel request.

            Thanks Boca for the help with the Trust Fund E. Do you need to get a written release from the owner to use the estoppel or can they do this verbally with the resort?
