  • Cancellation of Agreement

I recently bought into BG but after reading post yesterday, decided to cancel. I purchased in Tennessee, which according to their paperwork gives me 10 days to cancel. I am only in my fifth day. The cancellation says to mail certified with return receipt to the Boca Raton address. It also states to return the materials provided when I purchased. Do I return my copies of the paperwork we signed as well, or is this only talking about the reference books from BG and RCI??? Also, since it says I have 10 days, should I overnight the package or not??? Advice please!

Definitely Fed Ex so you have a tracking mechanism. I would send back everything, and follow their instructions to the letter. It wouldn't hurt to fax your letter as well.

Good luck to you, and welcome to TS4Ms.

I would NOT return the documents you signed. In case of confusion later on, or loss, you will need those. I would keep a copy of the rescission directions also.

Send the letter to rescind by certified mail. ASAP!!

Keep allyour paperwork. Send the books and magazines you got from RCI & bluegreen back at the cheapest rate (UPS?) you can. The only thing which has a time limit is the letter to rescind.

          Canceling BG Contract

I would keep the originals of the contracts you signed, but make copies of them and include in the package you mail back. Also copy the cancellation letter and make an inventory of all the other material you are returning.

I appreciate everyone's help. I sent the letter today, express certified with return receipt. I had packed up all the reference materials and copies of what they had given me. They, of course, kept all the originals, all they gave me were copies. I kept copies of everything that I am sending back to them. Now I am wondering if I should've sent them the copies I made, and kept the copies they had given me ( theirs were on legal, mine are on letter sized paper)hmmm..... Again though, I REALLY appreciate everyone's help with this!!!

              Rescission Letter

Now that you have sent everything back, don't worry about it. If you sent a letter saying you want to cancel and sent it within the required time, then you should be fine.

DO KEEP a letter of the rescission. Do keep a copy of the method of verification of BG receiving your letter, whether, certified, FedEx, or UPS.

If you have or have not sent back the books, offer to do so requesting BG give you directions on where to send. You will need copies of all correspondence, however small.

They will not contact you regarding receipt of the rescission letter. You can e-mail them after you have confirmation they received the letter. They will then contact you that they have received your correspondence.

If you gave them any monies for down payment, they have 30 days to refund that money. They quote 30-45 days. You bank card, if that is what you used, allows them 30 days. Stay on top of that. At 30 days, have your bank card company place a hold or dispute on the charge. That way they cannot begin to charge you for things like where you stayed, if you did, or any other small charge they might deduct from your money.

              Good luck

              Best,

              Richard

What needs to be in the rescind letter? The only instructions on canceling I can find in the contract reference the time frame (10 days) and where to send the letter. Should I contact BG first? Who at BG should I attempt to contact (sales lady, inventory specialist, or closing person)? I'd most likely send the letter first class mail return receipt and/or certified.

If the post office did lose it (unlikely but possible) is proof you sent it good enough if the 10 days rolls past? Perhaps I'll send 2 rescind letter 1 day apart just in case.

If I call will they try and wheel and deal or just say okay no problem send the letter?

Do you get a full refund or do you lose closing costs and/or other moneys? Are there any negatives associated with rescinding? If down the road I wanted to purchase would they allow it?

Send everything you got from bluegreen to the recind address. Send it certified so it has to be signed to receive. Keep all your records of when you sent, anything you get from the post office for proof of delivery, etc.

I have not heard of any case where when the info was received withing the recind period that there was any problems.
