I have been a BG owner since 2004, purchased a resale of UDI at Shenandoah Crossing plus 9000 points. Last year, in January 2008 I attended a promotion in Norfolk VA for the Patrick Henry Square in Williamsburg VA. They made a presentation and, based upon that, I agreed to trade my UDI for 12000 points. The price was $13,000 and change, with a 6K and change equity credit for the UDI, leaving $6K and change that we financed. They said their copy/fax machine was not working and could not give us copies of the paperwork we signed. So they scheduled a free weekend at Patrick Henry to complete the transaction. We went a week or so later and went through the paperwork again. I wanted to make it clear that I was trading the UDI only and not the points. They showed us paperwork that guaranteed this. However, again, we did not receive all the paperwork by the time we left. We were told that we would receive all of it when the sales manager signed off. Several months went by and nothing happened. However, in March, we started receiving bills for the mortgage payments. I kept calling Bluegreen and the sales center in Wmsbg. The salesperson said that the paperwork was submitted and they had no record. Bluegreen said they had no record of any transaction but the mortgage payments being due. (AND, to make matters worse, because of the overdue mortgage, we got locked out of the account). In April sometime, we received some more paperwork to sign, being advised that they had lost the originals signed at the beginning of the year. After weeks of attempting to find someone to talk to, and several months of being dunned for mortgage payments, we finally found someone who could give us answers. The deed or whatever was recorded in June of 2008, I believe, and we paid the bill. NOW, on the anniversary date of the points, we received the 12,000 points but no 9000 points. I called BG and now they are telling us: 1) we never had 9000 points but traded the UDI for 9000 points and 2) upgraded the 9000 points to 12,000 points. So all we got, in sum, was 3,000 points. This is simply not so and since we never received all the paperwork we have no way to trace back. Furthermore, they won't send us our paperwork. They say they have a paper that says basically what I set out as 1) and 2) above. I know that is not the case because I specifically told the salesperson that I would not do the deal if we lost the 9000 points as well as the UDI. And, I basically am paying 13K plus for 3000 points, having completely lost a perfectly good UDI in the process. I need help from someone who knows how to deal with them. Their attitude is "that's the way it is. There's nothing you can do." I feel there must be something I can do.

I would talk to a lawyer - around here, they'll usually meet with you once for nothing - but I don't know what your chances are without documentation. Personally, I find the lack of paperwork upfront extremely suspicious. I dunno how things normally work, but if I'm going to sign something away I want the contract before I leave. Not saying all salespeople are crooks, but I want everything in writing just in case. That they didn't give you the contract from the git go says all kinda bad things about them in my book.
But without any records, they may be right that there's not much you can do.
