    A few years back, a major newspaper contacted me because of comments on a certain other forum. That was during the good ole days, and they contacted me to get a proponent's side of the story.

    Then, they pulled comments out of context, to make it sound more like I do now. Perhaps they had one of those fancy Delorean time machines.

    Of course, when I asked for a retraction, they no longer were available.

    Others on these forums have been involved with the mass media.

          You're not the first to suggest that, but so far I haven't heard anyone suggest what seems to me reasonable basis for a suit. "I'm mad and don't like that the resort levied a special assessment" isn't going to go very far.

          First, who would you sue - Diamond Resorts or the Association of Apartment Owners at Point at Poipu. (Note that the assessment was not levied by Diamond but by the Poipu AOAO).

          If you propose to sue Diamond, on what basis would you be suing them since they aren't the entity that levied the assessment? If you propose to sue the Poipu AOAO, what specifically have they done that exceeded their authority or charter? And if you do sue the AOAO, you are essentially suing yourself and any costs incurred by the AOAO will simply be included in the assessments charged to owners.

            Yeah, that has come up several times in this thread. I'm sure that information is being held close to the vest.

            Have you asked via the website the owners have set up?

              I am living in Canada but traveling to Mexico. I am stopping briefly in Northern Arizona to do some hiking.

                    • DRI agents saying over 75% have paid!! LIES LIES LIES

                      DRI has been trying to force deeded owners to a points system or out for a while now. In 2007 they threatened me that if I didn't pay another 5k for points then I'd have a very difficult time booking! I told them to go stuff themselves back then - the unit we had was a MESS. Tons of mold, the ac units not working and the unit overall looked disgusting. And yet their sales tactic was to tell me I needed to pay more!! Morons!!! Apparently the 'renos' were coming to that building, but quite frankly the entire resort looked like it needed overhauled We didn't see ANY units that had already received the sprucing up they claimed. If I hadn't already paid out my 2 weeks I would have been dumping it then. Unfortunately I've continued to pay out their ever increasing annual dues and putting more good money after bad. And now these additional SA fee's really show their arrogance. DRI will tell you over 75% have paid and it's a pressure tactic to make you feel like you'll miss out if you don't. Everyone should have banded together in the beginning and not paid a cent - dues or SA. That would have been the strongest voice and message.

                        • Class Action has been filed !!!!

                          According to sources on the internet, a Class Action lawsuit was filed last week against Diamond Resorts regarding the Poipu issues.
                          It was listed on another forum.
                          Filed in US District Court for the District of Hawaii

                          • By coincidence, I noticed a Poipu Bay bag tag on a couples' golf bags. When I struck up a conversation, it turns out they own(ed) at the Point, or whatever they call themselves today.

                            They said they just bought a week at Stormy Point Village (Branson) and as part of the deal Summerwinds took their Point week, assuming their SA.

                            Yup, that's what they said.
