    From my knowledge of the resort, you are guaranteed that view but in a roving number of units that have that view. The guy who really knows the answer is Dave Weiss, the Broker at the inception, but he is no longer with them.

    I send an email to Simon Crawford-Welch on Sat, 17 Jan 2009 11:38 am. Maui time.

    I received an email on Sat, 17 Jan 2009 11:45 am from Simon Crawford-Welch. It was not a form letter. It was addressed to me by name.

    He wrote, "You have my commitment that we will respond to your concerns in a timely fashion.

    Please allow us a day or two to address the issues you raise."

    About 12:05 pm on Sat. 17,2009, on my way to Mama's Fish House, I received a cell phone call from DRI from London, England.

    I don't know how this will turn out, but they seem to want to work with me.

        From the Grid it appears that I would need 11,500 points for the week Jan. 10 to Jan. 17, 2009, if I was a Points owner. So I would assume that I have more than enough credit or points to get a Deluxe Ocean View Unit.
        You've touched upon one of the reason's that I converted my Polo Towers ownerships to THE Club, I can manipulate my points in such a way as to get more value from my ownership than just being a straight weeks owner. However, this works well for us because we do not want to visit a specific DRI resort on a regular basis and we are not currently interested in using Polo Towers as a home resort. Instead, we are using our ownership strictly for exchanging and, we're planning on using it to exchange into an area('s) that can be aquired easily during the Flexchange period, which as it stands now requires 50% fewer points.

        But, my usage as stated is not for my home resort. I'm not certain how this would work out if I wanted a float week at Polo Towers. I've looked a couple of times, just for giggles, and haven't seen availability for the times I would want to go. But, Polo Towers wasn't sold originally as a points based reservation system or as a trust based membership. It's possible that, if enough owners paid the $2,995 conversion fee, something I'm assuming most owners would be hesitatant to do at Polo Towers after that big special assessment, inventory might look a little better. Perhaps this would be a problem with KBC.

        If you think that you could get what you wanted for fewer points than you would be alloted in either THE Club or the Hawaiian collection trust, converting to either might be a consideration to stretch or maximize your ownership.

        I realize this post is slightly off topic but, it would be something I would at least consider if you're current ownership situation is not what you had intended and you intend to continue to return to KBC, even if this dispute in not resolved to your satsifaction. I suspect that, in the end, your going to find the DRI is adhearing to the letter of the original agreement whereas in years past Sunterra was maybe not doing that so much.

        I know that Polo Towers had a similar issue when they allowed fixed week units to "float" anytime when it was first under construction and had a propondurance of developer owned units. The salesman even sold those fixed units as "floating" units, even though that's not what they were telling/selling people. When they corrected things to what the actual contract said, it made a huge difference in how we viewed our fixed week unit and, we originally felt we had been lied to by DRI when we were in fact lied to by the salesman.
