  • Aruba Surf Club finally passes ROFR!!!!

    For those who have been following my story...heard back from Shelley at Transaction Realty and my 2 BR Gold Aruba Surf Club Oceanside passed Marriott's ROFR for $15,500. Took a little over three weeks.

    Honestly during the waiting period I was starting to get cold feet thinking that we were better off renting than owning but now I am excited!

    If you recall my saga this unit has no MF and usage until 2008 and that is why Shelley thinks it was able to pass. She is really terrific and I would recommend her to anyone. I was actually quoted the same price and higher on other OceanVIEW unit so I feel we got a great price on a unit with an even better view!

    Settlement is 1/19 and then I guess it would take a few weeks for Marriott to recognize me as an owner. At that point it makes sense to join II, correct? Any other first timer tips for a new Marriott TS owner? One thing I did earlier was apply for and just received my new Marriott Rewards VISA card.

        Thanks guys. My wife just noticed something on the purchase contract (which I need to get signed and back to the broker by 1/19/07 with a Bank Check or the balance). Here it is:

        YOU MAY CANCEL THIS AGREEMENT WITHOUT ANY CANCELLATION FEE OR OTHER PENALTY BY HAND DELIVERING OR SENDING BY CERTIFIED MAIL THE NOTICE OF CANCELLATION TO TRANSACTION REALTY , 3423 STANTON DRIVE, SALT LAKE CITY, UTAH, 84120. THE NOTICE MUST BE DELIVERED OR POSTMARKED BY MIDNIGHT OF THE FIFTH (5TH) CALENDAR DAY FOLLOWING THE DAY ON WHICH THE AGREEMENT IS SIGNED. IN COMPUTING THE NUMBER OF CALENDAR DAYS, THE DAY ON WHICH THE AGREEMENT IS SIGNED AND LEGAL HOLIDAYS ARE NOT INCLUDED.

        I have obviously not signed the agreement but wanted to check on this. Resales have the same right of cancellation as buying from the developer correct? I did not realize that I could cancel this contract and I had mentioned above that during all the waiting we were starting to get cold feet (esp. the wife!). Again not to dampen the mood here but just wanted to get clarification that I could cancel this and get my $1000 back if our heart's not in it. When does the five day period begin if I have not even sent the signed contract back yet?

        Almost certainly we will be purchasing but keeping options open.

          I am surprised to see that the re-seller would have an 'out' clause...once they have your deposit....Hmmmmmm...new to me.

            That's what I thought. I know you have a right to cancel with the developer but I was suprised to see this. If I cancelled would I also get my $1000 deposit back?

              It makes sense that the rescission laws written to protect the consumer are not restricted to developer sales. If it is indeed "rescission," then you should be able to get your $ back, but how easy that is will depend on the integrity of the seller.

                Sounds like you got a great deal! Congrats! Even so, I know it's hard to commit a big chunk of change like that. Even though I got a great deal on my Marriott (which was less than yours) I too had second thoughts about spending that much money on a timeshare. We did go through with it, though, and I don't regret it. I know that I would be able to get a good price if I ever sell it. Funny that I didn't have such second thoughts when I purchased my Harborside from the developer for 4 times as much. Gosh, they do a good job with the brainwashing!

                If you do cancel, and if you purchased via ebay, a negative I could think of would be that you would risk a "non-paying bidder" complaint on your ebay account.

                  I also think you have to check your initial paperwork which you signed when you sent the $1000 deposit. I think it contained a clause as to the effect that if you cancel you are out the $1000.

                  In some respects it may be better for you if it does- because then maybe it would shove you off the fence and let you return to . It is always easy to second guess yourself, but from all your posts I think you'll be happy when all is settled.

                    Just to update an old thread...we put our second thoughts aside and closed on 1/18. I called Marriott today and they told me they have the transfer paperwork and I was told it could take up to 8 weeks until we are recognized as owners. Any tips to speed this process up?

                      Marc.....Just stay on top of things. Call in a couple of weeks to see how things are progressing, etc.

                        Here's what I'm going through. Bought resale too at Marriott Aruba Surf. A 2BR lockoff gold season garden view for $12,500.

                        Anyway, Marriott received the paperwork on 01/03/2007.

                        I tend to call them every couple of weeks cuz I feel I am running out of time with trying to get my exchanges this year. The first time, they told me it could take up to 60 days.

                        The second time I called they said it could take up to 3 months. They couldn't even tell me where in the process my paperwork was.

                        I am very frustrated with Marriott. Aruba doesn't even have a deed to transfer, so what is taking so LONG!

                          Since you bought through Shelley let her deal with it. I know she has contacts there. She kept me posted on the status whenever I inquired. Once Marriott had the paperwork she said it should take around a month. At the 3 week mark they were working on stuff received 2 weeks before mine. Given that Thanksgiving fell in between, I don't think it was bad that it took 5 weeks total. At that point she e-mailed me my owner's number and unit information (necessary for II). It took about another month for me to get everything from Marriott, but the info. Shelley sent me was all I needed to set up an account online, make reservations, etc..
