Update on FF Class Action Lawsuit.... Dismissed...

Steve Berk, lead attorney for the Grimes Complaint, emailed me today and asked that I share this information with FF owners.

About a month ago, Judge Conway denied his plaintiff's motion for class certification.

They are considering an appeal and a derivative action elsewhere or individual actions in other states. He appears to be trying to continue with the case, but it doesn't look good.

A reasonable decision by a court. Even a stopped clock can be right twice a day. If the "injured" parties have to pay to continue the hurt suddenly won't be so bad anymore...

There are some very serious issues like the huge conflict of interest of the developer controlled board for the points trust that really needed to be cleaned up, but as I recall there were some real questions about the factual basis for these plaintiffs complaints.

Unfortunately the RCI lawsuits also suffer from serious flaws in factual issues for the complaints. Lets hope there are at least two courts that get it right.

On the RCI lawsuits, the factual basis will need to be developed by use of discovery, and it is likely that they will find what they need in the discovery process. My concern is that as the two lawsuits are merged, that one issue addressed in Murrillo but not in Chase survives in the new complaint. Arguing that issue, IMHO, may be critical to the success of the lawsuit.
