We just lost out on a great deal at Bali Hai because David Walters stopped our purchase based on ROFR. He does not even have ROFR on any of his sales contracts before July of 2005. This really is bad news for us, as we wanted this week.

We were just told by Peter Clark in the sales office (big fat liar) that Wyndham is not doing ROFR, but this one is signed by David Walters. I thought he sold out to Wyndham? I am very unhappy with this decision.

I don't know, Bill. They say they have ROFR but do not have it on any contracts written before July of 2005, according to the information I have seen and heard.

The one time I talked to Marjorie at PAHIO, the gal that works for David Walters and signs the ROFR, she said they have a phrase that kinda gives them ROFR, about how they need to approve the person who buys????, but this has never stopped any of our other sales before. She was very nice about the other purchases and the last purchase we heard virtually nothing.

Salespeople are big liars! We heard nothing but lies from the sales office and rescinded our Fairshare points purchase. That is why they are exercising their ROFR.

I don't understand how David Walters is still around when Wyndham bought PAHIO? When has Wyndham/Fairfield ever exercised any ROFR on anything--ever? Now we are being kept from buying a week we paid for over a month ago? This is a rotten deal.

Try contacting the states real estate department to find out where to file an official complaint. I'm not certain if filing a complaint will help you get the week you want and have paid for back (assuming you accept the refund of your purchase price) but it might let them know you intend to be serious about any rights you might have.

You might also contact the states AG to see if there's any complaint that can be filed for unfair trade practices or whatever there might be for exercising a ROFR that you do not believe they have.

Of course, this takes some work but often I find they count on people not being willing or not knowing how to do it. Good luck and I hope you get the week back that you want.

Thanks, Doug, I do hope we can do something! Perhaps Marjorie can change things, but this is really just sour grapes because we rescinded our Fairshare contract.
