I am in the procesing of purchasing a Marriott week and the current owner has already booked a week for 2009 through II. I can I gain control of this week? Can the II membership be transferred to me? Can II transfer the week to me? My concern is clear title to my ownership.

The week for 2009 is reserved thru Marriott directly as u will do every year going forward.

The current owners have deposited the week into their II account.

IF the use of the 2009 week is part of your purchase contract, then yes, the current owners can 'transfer' the week to your II account. It will be called 'something else' but it will be the same week with the same trade power and the same expiration date. If the seller ONLY has this one week in their II account, they might agree to have the whole account transfered over to you - sometimes II will allow that. Your other option is to start ownership in 2010. Either way, it should be clearly stated in your purchase contract.

The use of the 2009 week is a contractual issue and has nothing to do with 'clear title'
