    You May be Entitled to a Payment from a Class Action Settlement About the RCI Points® Exchange Program

    A Settlement has been reached in a class action lawsuit that claims that RCI, LLC violated certain consumer protection and other laws by renting timeshare inventory deposited by members of the RCI Points Exchange Program. RCI denies it did anything wrong.

    Am I included? You are included if you (1) Are a resident of the U.S. or its territories, and (2) Were a member of the RCI Points Exchange Program on or before April 25, 2012. If this postcard is addressed to you, you are included in the Settlement unless you exclude yourself.

    What can I get? If the Settlement is approved, Settlement Class Members who submit Claim Forms may receive a payment. Current members may get $12 and former members may get $10. Claim Forms are due by August 24, 2012.
    What are my other rights? If you do not want to be legally bound by the Settlement, you must exclude yourself in writing. The exclusion deadline is October 2, 2012. If you stay in the Settlement you will not be able to sue RCI for any claim relating to the issues in this lawsuit. If you stay in the Settlement, you may object to all or any part of it by October 2, 2012. The Court will hold a hearing on November 1, 2012 at 10:00 a.m. to consider whether to approve the Settlement and a request for attorneys' fees, costs, and expenses in the amount of $835,000.00. The Court has appointed attorneys to represent the Class. You may hire your own attorney at your own expense.

    Wow! I get a whole $12.

    No wonder it's only lawyers who advocate class action law suits.

      Another sellout by unethical class action lawyers! They get >$800K, or as the old country music song goes, they get the gold mine while the clients get the shaft. These golddigging lawyers, like their counterparts in the Weeks sellout, did not even do discovery to know what sort of a case they had before raising a white flag, giving their clients no real relief but themselves a hefty payout, and letting RCI continue its malpractices with no meaningful injunctive relief.

      Personally, I think all class action statutes should be amended to require meaningful injunctive relief to cure the matter complained of as a condition of award of attorney fees. If they do not achieve that, they should not be entitled to any fee.

          RCI denies it did anything wrong. The Court did not decide that RCI did anything illegal or wrong. The Settlement does not mean that RCI admits that it did anything illegal or wrong. The Settlement avoids the cost and burden of continuing the case.
          It was all about the Pay day huh? I can't believe that any of the main claimants in this case agreed to quit for $12!

                I have been party to a number of these class-action lawsuits (not by choice) where the settlement was absolutely NOTHING! But the lawyers raked in a tidy sum. Our legal system at work.

                  Yet another in many examples of why when people start crying Class Action Suit it is a joke. This is the outcome 99.9% of th time and things are no better than they were and may be worse as the process gets an unofficial blessing with the settlement.

                  And getting the Government involved is no better. Look at the suit they WON against Microsoft then they gave it all away for some meaningless fines. You have to vote with your dollars and expect no help from lawsuits.

                    I started filling out the online form because I think RCI points has been annoying and inconvenient for me. I got to the part where it asked which resorts I wasn't able to book because of RCI renting them out. So, I gave up. I have no idea which resorts they rented or even if I couldn't get one because of that.

                      I don't even bother reading past the first few lines of these settlements anymore. They're almost always a joke. I can hardly wait to see the result of the class action against DRI's the Pointe at Poipu resort. My bet is it will cost the owners a ton and return almost nothing.
