Congratulations for finding this forum in time. After you have rescinded your contract, the developer may try to reach you and try to make you change your mind with some extra goodies. Don't change your mind and spend more time in this forum before you buy again.

You can buy a re-sale timeshare condo later which is identical to what the developer sold you. Timeshare condos keep coming back on the market all the time so you don't need to be in a hurry. Just remember that it is very easy to buy a timeshare but not so easy to sell it unless you sell it dirt cheap.

Would I have to send in the contracts ??? Like the RCI ones etc?I will return the books they gave me but, was going to keep the contracts for future reference in case I have any problems getting my deposit back.:confused

Keep a copy of everything for your own records. That's what I would do.

its the never ending nightmare- The person I'm staying with in the states sent the revocation letter etc. express mail return receipt but the post off ice never put the return reciept on the receipt the gave us back!!! What the heck to do now? Eldorado resorts corp will make us pay now as we didnt follow the instructions exactly... I'm losing sleep, and am sure I've aged overnight :-((

I don't think that you have to worry because the return receipt comes back in the mail to you after the person at the company has signed that they have received the letter. Which address did she fill out for where the card has to be returned to?

Did you get a receipt? You should have so go back to the post office again, if you have any doubts. If the person in the USA did this for you, he or she most likely did it right.

Keep us posted and you should have a receipt for your transaction so you can double check. Very seldom do these letters get lost but they did once for us over all the years we have used this method of sending something.

When is your recission deadline? If don't think you'll have a problem with the lack of receipt for your letter, but if you are worried, and are still within the deadline, just send a second letter.

I'm not an expert on this, but I think you'll be OK. The resort would have a VERY hard time arguing that express mail isn't a valid method of notifying them. A method that didn't use the US mail, such as FedEx, might give them more grounds to try to get out of rescinding.

In general, resorts usually don't fight recissions, at least not in the US and other countries with reasonable consumer protections. It would get them in serious trouble.

Technically, it could be a problem but not if it is an ethical company which I hope it is. On top of that, you are a tourist so you are less aware of how everything works over here and your friend thought that she did it even one step better than was necessary.

They should have received the letter already today if it was sent by express mail. I would be on the phone with them and see if you can reach the right department and find out if they have received it and ask them how soon you will receive your money back. Tell them from where you are and they may even expedite it for you. Be nice to them as they are only doing their job. I hope everything works out for you but please, let us know.

It's strange how timeshares work. This person will save thousands by not owning in the form of yearly fees which will almost always increase each year for as long as they " own " it.

yay!!! I just rung El dorado resorts corp...thanks Jim for the advise to call.
They received my revocation letter today - I spoke to the operator, he assured me that all the agreement has been cancelled and they will not bank my cheque , but the post office attenedant DIDNT put in the return confirmation!!! And the operator said because of that they cannot send me anything confirming receipt... The operator seemed nice and did say not to worry about it any more- I got his name too in case I need if any future problems arise.
should that be the end of it all??? need I worry any further, do I need to notify RCI , could any other complications arise???

If you sent it express mail you should have a tracking number. You should be able to access and track your letter online to verify that it was delivered on a certain date. In addition, I believe that the law states the date of mailing is the offcial date for legal matters. If push comes to shove I'd be looking that one up to verify if it's true or not. At the very least you definately have intent on your side and you intended to cancel the contract within the specified time frame.

One other point, you stated you intended to rent out the unit and use bonus weeks for vacations. This sounds as if the saleman crossed a line by selling this as an investment. That's a BIG no-no for a salesman to do. Especially since I suspect you would never have been able to rent that unit for enough money to even cover your MF's.
