    I recived the following this morning from TS Today. Hopefully, we'll see something happen from this.

    (TimeSharing Today's publisher received the following from Susan Collins, who will be appearing at the RCI Class Action Settlement Fairness Hearing on June 16th.)



    "Shep, Some good news - The presiding Judge in the Fairness Hearing has decided to hold the hearing in Newark, NJ as originally scheduled instead of having it in Trenton where he now sits. This eliminates the concern about people not getting notified about the location.



    I was also advised to send a letter to the court and to the attorneys representing the Defendant and the Plaintiffs, enclosing copies of the emails I received from TimeSharing Today's readers and requesting permission to speak for those people who contacted me and agreed with my perspective of the problems with the settlement. I will ask the Court to send the attorneys back to the bargaining table and come up with a better settlement. In that case, I am hopeful that the judge will order that all members of the Class should receive notice by mail that includes full disclosure of the new proposed settlement, accurate information about opting out, filing claims and filing objections and ample time to file.



    The Fairness Hearing is open to the public. So, I encourage all RCI Weeks Members, who live within a reasonable traveling distance, to come and be present on June 16th at 3 PM. Here is the information about the location. The presiding Judge is Peter G. Sheridan, U.S.D.J., The RCI Class Action Settlement Agreement Fairness Hearing, Courtroom 4C, Martin Luther King, Jr, Federal Building & U.S. Courthouse, 50 Walnut Street, Newark, NJ 07101.       Can somebody please explain (as basic as possible) to me what the deal is with the class action lawsuit. I own 2 weeks at Orange Lake and 1 week at Negril Beach Club - all are fixed weeks and trade through RCI.

        RCI rents out timeshare inventory to the general public weeks through a variety of methods that have been deposited by timeshare owners for exchange and then are no longer available for exchange.
        Hundreds of thousands of owners are not able to access exchanges that used to be available both in the long term but especially in the short term.
        The RCI directories used to advocate the Instant exchange (exchanging in 45 days to 2 days before check in) very clearly that allowed off season weeks to exchange into Red time and smaller units to exchange for larger units. This upgrade benefit is why hundreds of thousands of people bought (or were sold) off season weeks and smaller units because they were able to exchange in 45 days or less and upgrade accessing the cancelation, bulk, still available, late deposits and excess inventory.
        This benefit was eliminated by RCI and removed from the publications because they rented out the units. RCI changed the Weeks website so you cannot access inventory unless it is at least four days away.
        They also rented out prime inventory and allowed RCI Points owners to access exchanges from RCI Weeks inventory using very little of their points allocation without returning any inventory.
        This sales ploy to motivate Weeks owners to convert to points by telling Weeks owners the Points program would eliminate the Weeks program inventory and eventually they would have nothing left. Another high pressure lie told by conversion salespeople to Weeks owners that Weeks was ending and everyone was going to points.
        The settlement being discussed is totally inadequate and does not address the 45 day or less issue at all. The settlement is being rejected by most RCI weeks owners because it orders RCI to make some minor changes for a limited period of time.
        Lastly, RCI weeks owners were inadequately notified of this proposed settlement.
