    I recently purchased a 2nd week at the Fort Lauderdale Beach Resort. I already own 1 week and bought a second week so we would have the option of going 1 week or 2 or renting it out or trading etc.

    Because we are already going this year in March we offered the new week to friends of ours but they could not go. So I decided I would go for 2 weeks and my wife and daughter would go for the 2nd week. I called the resort and asked what would I need to ensure I could use this 1st week before I changed my airline tickets. They told me the previous owner had put the week into RCI as a trade and that would have to be resolved before I could use it. I called the selling agent and they were shocked to learn this about the owner since part of the closing costs would be 2007 maint fees. They called me back and said the week could not be gotten back and they would refund my 2007 maint fee. I agreed, but now have been thinking about it. They assured me when I made the purchase the week would be available to use this year, they were unaware what the previous owner had done. Should I ask them for some type of compensation, does this sound fair or just getting back my maint fee is good enough.

    I purchased it a good price and through a big selling company who I do not wish to mention. What do you guys think

    I think the misrepresentation about this year's week is enough to warrant your canceling the deal if you want to. If it's a big broker, they should be willing to give you your money back if you want to cancel. If you want the week either way, then it seems fair to just get back the MFs and start your usage next year, unless you think the purchase price was inflated because of this year's week.

      I do not want to cancel the deal. I offered $1200.00 less than their asking price. I got the week for $1000.00. Part of the closing costs included the 2007 maint fee which they have refunded to me. I was not sure if they should be giving me money back from the purchase price or what.

        Ben It sounds to me that they made good if you got the MFs for 2007 back.
        Especially if you want the week going forward.

          I doubt you will get any compensation. Since they gave you the 2007 maintenance fee back, the only thing you are really out is the time value of your $1000 purchase price for a year. I suppose it wouldn't hurt to ask, but I wouldn't expect anything. What happened to the deposited week? Did the seller use it? You could always ask to have it transferred to you for a reduced fee.

            I was just told the week had been deposited and could not be taken back. Not sure if had been spoken for yet. They offered to find me another unit but they would not have given back the 2007 maint fee.

            So I guess I made out okay

              Yes, they squared the deal with you when they gave you the 2007 fee back.

              If you want to go for two weeks in 2007, deposit a 2008 week and trade for 2007.

              However, not being able to get a week deposited with RCI back is often misunderstood because of the verbiage that says a deposit is a final transaction. It is not.

              A deposit may be withdrawn by the deposting member, sorta at the disgression of RCI, but I have never had a withdrawal disputed. In the past years I have deposited, withdrawn and redeposited two weeks.

              In my experience, a deposit can always be withdrawn if it has not been requested and the depositer has not made an exchange with it.

              In real life it can also be withdrawn even if it has been requested and assigned to another member, under certain circumstances. Feel free to email me to discuss this.

              I have seen this resort in my daily searches. Although we prefer the left coast, what is this resort like? The picture looks nice (but the $1000 resale price makes me wonder).

                We'll be there Feb 16th

                The reviews look pretty good, lots of comments on updating units.

                This is the resort that the emergency RCI VC found us when we were dealing with a 12/30/06 need and then I happened to ask about our ongoing search for 2/16, which had NOTHING listed as avail and nothing coming up. Suddenly she had this one avail

                I think we will be happy with it, but I want to know why it was suddenly avail - there was no time on the phone for her to be checking around for additional weeks for us, and it had not come up on the search - then suddely, it was there.??
