Why Has there not been a Problem until DRI took over?
I just went on the DRI website and also found where they have a point value on my week, although I am not a Club member. I am a deeded owner, always have been, and do not wish to be part of DRI's tactics and manipulation. I just want exclusive use of my unit when it is available. f we are not part of their "Club" why are they putting points values on our Contract #'s?

Was the resort completely full when you arrived? If not there shouldn't have been any issue with getting an oceanfront unit as a Deluxe Ocean View owner. They usually will upgrade everybody when there is room vacancy, just like any other resort hotel. If oceanfront is the best, and that is what you own, why would they not put you there? Somebody had to be in those rooms!

We stayed at Maui Hill for the first Week. It looked like they had a full house.
We stayed at the KBC for the 2nd week and 3rd week. It seemed full.
My son stayed at the Kahana Falls the 2nd week. It seemed full.
I went to the Owners meeting at Kahana Falls the 3rd week. They said they had a full house.
Yet the Maui news reported this.

Maui reports 60.5 percent, even with cuts in room rates
The other Neighbor Islands caught up - or caught down - with Maui in the November hotel occupancy statistics.
Maui, the previous high flier, had fallen the most in October, and its hotels continued to empty during November. Only 60.5 percent of rooms were sold, according to the Flash Report by Smith Travel Research for the consulting firm Hospitality Advisors.
That was a drop of almost 13 percentage points from the 73.4 percent of November 2007. Hawaii and Kauai had similar drops, finishing at 50.1 percent and 60.9 percent, respectively.
Oahu was down, too, but much less, from 73.9 percent to 68.5 percent.
It was the ninth month in a row that island hotel room sales have fallen. The decline set in even before the sudden failures of Aloha and ATA airlines in April, and the visitor industry had anticipated some cooling off from records set in 2007.
Nobody expected the declines to be so big. For the first 11 months, Maui's occupancy rate is down to 68.9 percent from 75.9 percent in 2007.
That is relatively worse than Oahu, down from 77.1 percent to 75.5 percent, or Kauai, down from 76.6 percent to 72 percent. It is about in line with the Big Island's much weaker visitor industry, which is down from 68.1 percent to 60.9 percent.
There are signs that operators are being forced to do something they learned to dislike intensely during the slow years of the mid-'90s: cut posted rates. They learned then that raising them back up was difficult.
Declines in rack rates are nowhere as big as overall declines in business, but they are becoming noticeable.
On Maui, the average posted rate was down $10 to $224. It was down $3 to $158 on Oahu, down $10 to $176 on the Big Island and down $11 to $182 on Kauai.
As a result, revenue per available room is down throughout the state.
It was down $11 to $108 on Oahu, down $26 to $136 on Maui, down $32 to $111 on Kauai and down $28 to $88 on the Big Island.
The highest-flier of them all, Wailea, fell the furthest in November. Rack rates there dropped $52 to $351 - still more than $100 higher than the second-most expensive destination, Kohala. Kohala rack rates were dropped only $10 to $245.
Occupancy at Wailea fell from 68.1 percent to 57.3 percent, compared with a drop from 61.8 percent to 45.3 percent at Kohala.
As a result, RevPAR at Wailea dropped $73 to $201. As a percentage, that was not as bad as the $47 drop to $111 at Kohala, but in dollars it was the most dramatic slide during the month of November.

Why has there not been a problem until DRI came into the picture?
I never had a problem getting oceanfront units - not as an owner of a deluxe ocean unit, nor as one who rented from an owner with a deluxe ocean unit.
How else can you describe a deluxe ocean view?
If anyone is familiar with that resort you would have to agree that there is nothing deluxe about that northside view. Garbage cans and a parking lot, with just a little side view of ocean?
Thanks Walt for the pics - they tell the real story! So who is DRI putting in our deluxe ocean view rooms?

PS.... I talked to a Fix week owner of 2 units for back to back weeks. They have a Fixed this week and next week for the same unit. on arrival KBC informed them they would have to move the 2nd week. The owners said No way. The 2nd week is their fixed week and KBC back down. But why would they even try do it?

Deluxe Oceanview is Oceanfront
When I bought my deluxe oceanview unit in 2005, it was still the Embassy Vacation Resort. The deluxe oceanviews were the oceanfront units. Buying in the deluxe oceanview category was the only way to secure the oceanfront. No problems until DRI came in and started converting and selling club memberships. What I would like for DRI to explain is why they use an oceanfront model for their timeshare presentation tours to market their deluxe oceanview, yet they deny the use of these units to its rightful owners.
Also prior to the changeover with Sunterra and now Diamond, all of the timeshare sales were fee simple deeded property. It's too bad the developer did not sell all of the inventory where we would have 100% ownership control.
No wonder so many have a negative view of the timeshare industry.

About 10 years ago I start buying on the secondary market buying at The Beach Club and at Fox Hills (I use this for trading), and at the Pointe in Upper Wisconsin. My best buy was at the Pointe from Ebay at $1.00. Paid $700 for my 2nd Fox Hills week and $500.00 for a 2 bedroom week at the Kahana Falls.
I traded into the Embassy at least 3 times, maybe 4 times, before 2001 (bought 1/24/01) with my Fox Hills Unit. I could trade into the Ocean View and the Scenic View but as you know I could not trade into the Ocean Front.
Yes, I saw the view from the Deluxe Ocean FRONT at the presentation. Since I could trade into, and in fact traded into KBC again on this Vacation (2009), why buy at the Embassy if you can trade or rent for less than MF?.

There was only one reason. I was sold, told, and bought a Deluxe Ocean FRONT Unit. If I was going to buy, I would only buy A Deluxe Ocean FRONT Unit.
My wife and I both remember our saleslady saying , "When we return for our Owner's week at the Embassy we will always be in an Ocean Front Unit."
By the way the Unit on my deed is #611. This is an Ocean Front Unit. We used our unit 2002 (used our 2001) week, 2003, 2005, 2007 and we were always placed into an Ocean Front Unit. I also have the saleslady's notes the day of the sale. It says, " Embassy Ocean Front". Is that saying something?
Only at this time, (first time under DRi), was I NOT placed in an Ocean Front Unit on check in.
Now I find out that we may have been Scammed and so were others.

So Who Is Getting The Ocean Front Units?
I found this review on Trip Advisor. So who is getting the Ocean Front Units? Could it be the Non-Owners that are using the KBC's Hotel services and are willing to pay the rack price of over $600/night?
Note the manager by giving them a credit of $100 or $150 was really saying that there is a difference between a Non-Ocean Front and an Ocean Front Unit.
Also Note, that she stayed in an Ocean View Unit that they are now calling Deluxe Ocean View Unit.

If you are getting an "ocean view" room, I recommend requesting a room on the pool side. The view is a little nicer. Both sides have an ocean view, but if you are on the non-pool side, you can see the dumpsters and stuff... On one of my trips, we had a "deluxe ocean view" room. Luckily, I had been there before and stayed in an ocean view because our "deluxe" was in exactly the same spot as our regular ocean view room. We booked the deluxe thinking it would be one of the rooms in the very front with an unrestricted full ocean view right over the sand. We went to the front desk to complain, and the manager was very nice and gave us a $100 or $150 (I can't remember) credit toward our bill so we could use it toward the bar/restaurant or parking or whatever. Apparently there are some rooms that are kind of gray areas and can be booked as either ocean view or deluxe ocean view. So he gave us a map of the hotel and showed us which rooms we would want to request a couple of weeks before our stay. So I suggest calling and requesting a room in the front if you are getting a deluxe ocean view 2-3 weeks prior to your arrival date.

Back in 2005 I Asked RCI On Tug About Rentals
Back in Nov. 24, 2005 I asked RCI on Tug about the large number of Embassy rentals available on RCI's Snap Travel Web site. I did not add them up but there must have been 75-100 units available between March and the first week in June 2006.

Was I Misled?

I found that my Disclosure listed a total of 106 Units listed in the Program. I asked for a copy of my Discloser I was given a copy that list 413 Units.
Several paragraphs have been added to the one one listed to the Disclosure listing 413 Units. It sppears to me that there are some inconsistencies in both Disclosures.
Example:
Type 1B.......Ocean View.......1 Bedroom.....Partial Ocean View
Type 1C.......Deluxe Ocean View......1 Bedroom.....Deluxe Ocean View
If Ocean View is Partial View then shouldn't Deluxe Ocean View be listed as FULL Ocean View or Ocean Front?
Type III........Deluxe Ocean View...........2 Bedroom......Oceanfront Location.
Units x08, x09, x10, x11, and x12 (x being the floor) are the units that are Ocean Front
Type III was unit #1208 in the 104 Disclosure form. The Location is Ocean Front. And both unit #1208 and unit #1212 in the 413 Disclosure form.
So if the 1208 and 1212 units are considered OceanFront Units, then it stands to reason that all units x08 and x12 must be OceanFront too. And I believe that it also stands to reason that x09, x10, and x11 must be considered OceanFront too. Which they are.
According to the Disclosure of 104 units, units 914, 915, and 916, (which are the North Side Units in the Ohana or Front Tower of KBC) are 1B or Ocean View Units. Therefore, the only unit on the North Side that is considered Deluxe Ocean View is 913.
The Discloser does list Pool side or x04, x05, x06, or x07 units as 1C or Deluxe Ocean View.
When I arrived at the KBC, the Front Desk was first going to put me either 614 or 615. These Units are clearly stated as Ocean View. This was in violation of my contract.
In summary, was I misled in the buying of a Ocean Front unit?
As we all know, exchanges were not possible into the Ocean Front Units. Sometimes, some fast talkers were able to talk themselves into Ocean Front. While I have been able to trade into the Embassy/KBC, I was never able to trade into an Ocean Front unit.
1) I was sold and told I could buy an Ocean Front ODD years unit for $13,900. I bought only because I would be getting to stay Ocean Front every time I used my owners week. Why would I pay $13,900 for something I could get for an exchange fee Plus $500 (my MF for my exchange week)?
2) Other say they also bought Ocean Front Units
3) My deeded week is 611 week 51. This is an Ocean Front Unit.
4) I had no problem getting an Ocean Front Unit in 2002, (my 2001 week), 2003, 2005, and 2007. Only this year 2009 (first time under DRI) did I have problems with getting my Ocean Front Unit.
