    Class-action set in timeshare suit | The Times Leader, Wilkes-Barre, PA

    ........ The case was filed on behalf of the lead plaintiffs, Albert Whitehead and Austin Miller-Orteneau of Philadelphia, against Vacation Charters Ltd. and W. Jack Kalins, owner of the Split Rock Resort in Lake Harmony and several other timeshare resorts.

    The men were paid as independent contractors for timeshare sales at the resorts, which meant they paid all their own federal income taxes with no contribution from Kalins, and were not provided any benefits, such as medical coverage.

    The lawsuit contends the men should have been treated as employees, which would have entitled them to benefits and would have obligated Kalins to pay part of their federal tax contributions, Kearney said. .............

    some stupid salespeople just don't understand that being an independant contractor is so beneficial to the salesperson. If I worked for this company I'd be able to determine what and how much in expenses I could write off...........saving me thousands of dollars in taxes. Those were the days. Now if I make 100K, I pay taxes on 100K. As an independant contractor I'd be eligible to claim expenses that I incurr. I can only claim expenses now as a portion of my income. I don't think many salespeople from this company will be standing in line to join this class action.

      Depends on what the underlying issue is. I bet that the plaintiffs have developed health problems and their need for health insurance out-weighs the benefits of being an independent contractor.

        Let's see, get reimbursed at least 7.35% of their gross pay for as long as they worked there. I'd get in line.
