If anyone has been scammed by them, get ahold of me. I know more than I can post.Last edited by JLB; 10-02-2012, 11:14 PM.RCI Member Since 24-Aug-1989/150-plus Exchanges***THE TIMESHARE GRIM REAPER~~~Exchanging/Searching/SW Florida/MO/AR/IA/Consumer Advocacy/Estate Planning/Sports/Boating/Fishing/Golf/Lake-living/Retirement****Sometimes ya just gotta be a dick

I have it from a pretty good source . . . someone who was actually doing the scamming . . . that Summerwinds/Stormy Point is scamming by design. They know they are not doing what they are telling peeps they are doing (getting the peeps' existing timeshares sold and putting money in the peeps' pockets so they can buy at Stormy Point), and they refund those who lawyer up or file complaints, but they are still coming out ahead from those who don't complain.
Of the 126 complaints at the BBB, almost all were canceled and refunded. And, being realistic, I suspect only a small fraction of those scammed actually file complaints.
In this case, the lying is not inadvertent.RCI Member Since 24-Aug-1989/150-plus Exchanges***THE TIMESHARE GRIM REAPER~~~Exchanging/Searching/SW Florida/MO/AR/IA/Consumer Advocacy/Estate Planning/Sports/Boating/Fishing/Golf/Lake-living/Retirement****Sometimes ya just gotta be a dick

I'm no. 127 on the BBB. They haven't replied yet but it should be showing up soon. They have two weeks to reply. And I think you're right on one thing...many don't file complaints. And one of the reasons I believe is they're ashamed of the fact that they were scammed in the first place. I know my wife and I are, and we don't consider ouselves "village idiots" but we're not going to be taken advantage of, as least not without a fight.

Apparently they sold you on the idea on timesharing, so if your get out of it - stick around and learn that there are much better places to buy for much, much better prices.

They know some will complain and the salespeople know those who do will get refunded and their commissions will be charged back. But, they don't care. They are making big bucks from the ---- that sticks.
The way I was told by those involved in the scamming is that once the victims discover they are victims, that they still own what they were told was being sold for them, they don't have beaucoup dollars in their pocket from that alleged sale, and that they also own at Stormy Point, which they never would have bought if they had not been told their previous timeshare was being sold for them, they figure they just got screwed again, like they did before.
In this case it is way more blatant and intentional than the normal lying and scamming to get people to buy.
As was mentioned in the thread linked to previously, the MO AG took action against Festiva and Branson Log Homes/Executive Timbers for doing the same thing.
Let me make this as easy for victims as I can:

At the bottom of this page:
http://www.bbb.org/southwestern-miss...040/complaints
there is an Industry Comparison chart you can click on. For the size of Summrwinds, no other company has had more than 25 complaints in the last 35 months. Summerwinds is, thus, the only one in the 100-plus complaint category.RCI Member Since 24-Aug-1989/150-plus Exchanges***THE TIMESHARE GRIM REAPER~~~Exchanging/Searching/SW Florida/MO/AR/IA/Consumer Advocacy/Estate Planning/Sports/Boating/Fishing/Golf/Lake-living/Retirement****Sometimes ya just gotta be a dick

I'm surprised the MO AG hasn't checked in on this one. As I remember, they were one of the more aggresive AG's at going after timeshare companies who were doing wrong. Our timeshare and other photo's at http://dougp26364.smugmug.com/

It is election year, and there are other priorities.
But, what is being done is so blatant, and there are so many BBB complaints, that there has to be some to the AG as well.
I have some experience with filing complaints with the MO AG, and some interesting responses from some interesting companies. I would talk more about this, and about how I am sorta trapped around a lot of timeshare salespeople, and "marketers", the ones we have talked about for years, but not on an open forum.
I have learned to be careful because of prying eyes, hatefulness, and vengence on the Internet. I have nothing to gain and something to lose by getting involved.RCI Member Since 24-Aug-1989/150-plus Exchanges***THE TIMESHARE GRIM REAPER~~~Exchanging/Searching/SW Florida/MO/AR/IA/Consumer Advocacy/Estate Planning/Sports/Boating/Fishing/Golf/Lake-living/Retirement****Sometimes ya just gotta be a dick

Florida man sentenced to 14 yrs in prison in Timeshare resale scam.
A Florida man was sentenced to 14 years in prison in a timeshare resale telemarketing scam that involved 54 victims in southern Illinois.
Brian Christopher Morris, 46, of Boynton Beach, Florida was sentenced to 14 years in prison, five years of supervised release, fined $1,000 and ordered to pay a $100 special assessment fee.
Morris pleaded guilty to one count of conspiracy to commit mail fraud and wire fraud in connection with telemarketing in February 2012.
The indictment alleged Morris and other were involved in a telemarketing scam in Florida that bilked more than 22,000 victims of $30 million in all 50 states.
Morris was a manager of Universal Marketing Solutions and later Creative Vacation Solutions in Palm Beach County, Florida. The scheme began in October 2007 and continued through January 2010.
Telemarketers called timeshare owners and falsely represented that the company had actual buyers for the owners' timeshare properties. They solicited advance fees up to several thousand dollars and promised they would be refunded once closing on the property occurred. Despite collecting fees from 22,000 victims, the indictment alleged the companies did not sell a single timeshare unit.
Several others have been charged and sentenced in the case.

I have had a few conversations with Pam Bondi, or those on her staff. I have told them it is nice that they are cracking down on resale scams, and although I understand how important it is to the State of Florida to appear to support the legitimate timeshare industry, it is, in fact, the shortcomings of the legitimate industry that has created the situation spawning resale scams.
I understand how she/they could not open the can of worms that (at least much of) the industry itself is a scam.
Yeah, the "No Exit Strategy" problem.
